So the Supreme Court could deny his request or, in light of Monday's Electoral College vote, decide to take the case away from the lower appeals court and decide quickly
The court has yet to respond to Trump's request

That's important because a state court judge has a 1:30 p.m. hearing in Trump's other case that would be delayed if federal court isn't done
