With time running out, and in the wake of a stinging defeat before the U.S. Supreme Court, @realDonaldTrump makes his case before the Wisconsin Supreme Court at 12 noon today
@realDonaldTrump And we're off, with Justice Karofsky to Trump attorney:
“This lawsuit, Mr. Troupis, smacks of racism. I do not know ow you can come before this court and possibly ask is for a remedy that is unheard of in US history."
@realDonaldTrump Justice Dallet quizzes Trump about absentee ballot form:
“What I’m hearing you say then is really the form was fine in 2016 when it helped the president win but now in 2020 when he has not won the state of Wisconsin, there is something illegal or improper about the form.”
@realDonaldTrump Justices Dallet and Karofsky, the first two to ask questions of Trump attorney, are part of court's liberal minority
@realDonaldTrump Karofsky questioning why Trump only sought recount in 2 counties
“How much money has Donald Trump raised because of the 2 county recount in the state? This isn’t about the amount of money this recount cost. This is about disenfranchising voters in only two counties in the state.”
@realDonaldTrump Conservative Justice Rebecca Bradley questions how the court can disqualify the ballots of people who were legitimately indefinitely confined, along with any who may not have been
@realDonaldTrump Trump attorney says Facebook posts is evidence that some voters who said they were indefinitely confined were not. He says of Facebook posts:
“Well, it’s pretty good evidence.”
@realDonaldTrump 30 minutes in, all three liberal justices have raised serious concerns wit Trump's Wisconsin lawsuit
And conservative Justice Rebecca Bradley questioned how the court could strike more than 28,000 ballots of voters who said they were indefinitely confined
@realDonaldTrump Trump attorney, who voted absentee, says his vote should not count because the form he used to fill it out didn't comport with the law
Justice AW Bradley asked:
“It just seems a little odd you’re standing before us and trying to disenfranchise your vote and say it’s illegal.”
@realDonaldTrump Justice Brian Hagedorn with his first question, which only an attorney could love:
“How should we look at these findings of fact? Should we defer to the circuit court’s finding of fact in this situation or do you believe a different standard would apply?”
Federal judge in Wisconsin dismisses Trump lawsuit seeking to overturn Biden win, says it fails "as a matter of law and fact."
Ruling came as Trump was arguing separate case before Wisconsin Supreme Court
@realDonaldTrump Judge Brett Ludwig concludes his ruling dismissing Trump lawsuit with prejudice with this:
"This Court has allowed (Trump) the chance to make his case and he has lost on the merits. In his reply
brief, (Trump) “'asks that the Rule of Law be followed.'” It has been."
@realDonaldTrump Judge's conclusion rejecting every Trump argument in Wisconsin federal court lawsuit:
@realDonaldTrump Now, back to ongoing arguments in Wisconsin Supreme Court.
Conservative justices, led by CJ Patience Roggensack, questions legality of Madison collecting absentee ballots at city parks, says the law says absentee ballots must be received by city clerk
@realDonaldTrump Roggensack says the Democracy in the Park events in Madison was very much like early voting, even though ballots were not handed out
Assistant AG Colin Roth says the lack of handing out ballots was crucial distinction
“It happened way before Oct. 20 when in person early voting could start. Here, people brought their ballots, somebody witnessed the ballots and collected the early ballots.”
@realDonaldTrump Get caught up on what's been happening the past hour (Hint: It's a lot):
@realDonaldTrump Conservative Justice Rebecca Bradley asks @JoeBiden attorney whether the court should not allow ballots cast contrary to state law
Attorney John Devaney says the will of the voters, even if relying on guidance that may have been incorrect, must be given precedent
@realDonaldTrump@JoeBiden Discussion in Wisconsin Supreme Court now turns to laches and estoppel, so you know.
@realDonaldTrump@JoeBiden Chief Justice Roggensack is the only justice in the Supreme Court hearing room
Justices Hagedorn and Karofsky appear to be in their Capitol offices
Three others are using virtual backgrounds to make it appear they are in the hearing room
Hard to tell where Justice R Bradley is
@realDonaldTrump@JoeBiden Biden attorney John Devaney says seeking to disqualify only voters in Dane and Milwaukee counties, and none of Wisconsin's other 70 counties is "a plain violation of equal protection.”
@realDonaldTrump@JoeBiden Trump attorney Jim Troupis, in reaction to questions from Justice Karofsky about why Trump didn't bring the lawsuit before the election, says:
“We do not want to disenfranchise voters, we want the laws enforced.”
@realDonaldTrump@JoeBiden Trump attorney alleges widespread fraud in election, and says this when asked by Justice Karofsky to detail what fraud occurred:
“The statutes are in place because they presume if you do not follow these provisions, there is fraud, undue influence and abuse.”
@realDonaldTrump@JoeBiden Justice Karofsky compares Trump to a king, accuses Trump attorney of being un-American by wanting to overturn the vote to keep his king in power:
“What is America? It is self governance. It is not governance from a king.”
@realDonaldTrump@JoeBiden Wisconsin Supreme Court arguments end, Chief Justice Patience Roggenasck says it will meet in closed conference at 2:45 p.m.
It's anyone's guess when its ruling will be released, but Biden attorney asked for it before Monday. Trump has asked for it before Jan. 6

.@realDonaldTrump has asked the Wisconsin Supreme Court to take his appeal over judge's ruling today against his lawsuit seeking seeking to overturn Wisconsin's election results
The court previously refused to take the case before it was first heard in circuit court
@realDonaldTrump Trump also filed an appeal in state appeals court
So the Supreme Court could deny his request or, in light of Monday's Electoral College vote, decide to take the case away from the lower appeals court and decide quickly
The court has yet to respond to Trump's request
@realDonaldTrump Trump asks for final resolution of the case not before Monday, when the Electoral College votes, but before Jan. 6, the date that Congress meets to accept the electoral votes cast by the states
Republican chair of committee holding an investigatory hearing into the presidential election releases list of witnesses who will testify tomorrow, led by conservative talk show host @DanODonnellShow and someone named Scott McDonald
@DanODonnellShow@samcdonell Others testifying include former conservative Wisconsin Supreme Court Justice Michael Gableman, Republican @WI_Elections commissioners Dean Knudson and Bob Spindell and "Concerned Wisconsin Residents"
Worth noting that the state's top elections official, Meagan Wolfe, is not on the invite list, nor is any other staff at the GOP-created @WI_Elections which administers elections
The board is bipartisan, but only 2 GOP members are on the invite list
@AP Federal court hearing, which the judge said yesterday he wanted to start promptly at 9 a.m., is delayed 15 minutes already after @realDonaldTrump attorneys can't connect to Zoom link
Federal court judge in @realDonaldTrump lawsuit in Wisconsin says he hopes hearing starting at 9 a.m. tomorrow will be over in the morning
That's important because a state court judge has a 1:30 p.m. hearing in Trump's other case that would be delayed if federal court isn't done
@realDonaldTrump The judge declines request from @GovEvers attorney to first rule on whether he has jurisdiction to hear the case before proceeding with the hearing
The same issue is at play in another federal lawsuit brought by allies of Trump in Wisconsin that is pending
@realDonaldTrump@GovEvers Judge Brett Ludwig tells @realDonaldTrump and defense attorneys that he wants to rule quickly following tomorrow's hearing on Trump lawsuit seeking to overturn election results:
