A federal court hearing in the case against Steve Bannon and his associates charged with conspiring to defraud donors of We Build the Wall will begin shortly.

I'll live-tweet for @LawCrimeNews.

ICYMI, Bannon now has a new lawyer... with a history. lawandcrime.com/high-profile/s…
The judge's clerk: "Mr. Bannon?"

Bannon: "Present."
But Bannon's new attorney Robert Costello did not respond to the clerk's roll call on the telephone conference line.
Costello just joined the line.
Bannon's old attorney Bill Burck, who asked to withdraw from the case for unspecified reasons the day after his client called for Dr. Fauci's and FBI director Wray's head, is going to join the line.

U.S. District Judge Analisa Torres joins the line.

She relieves Burck of his duty as Bannon's old counsel.
On the line for SDNY, Assistant U.S. Attorneys:

Robert Sobelman
Nicolas Roos
Alison Moe
Judge Torres recites the Brady boilerplate under recently established rules reminding prosecutors of their legal obligations.
First topic is the state of discovery.

AUSA says that there has been a substantial production.

"The govt is currently in the process of making a second, substantial production."

He adds it's "very substantial," pending technical issues of extracting drives.
Judge Torres: When do you expect you will be done?

AUSA: It's difficult to say, considering the imaging process and the need for a filter team to review for any possible privilege issues.

"I would be happy to give the court an update in a few weeks" or possible a month.
AUSA:

"We're moving as quickly as we can," he says, but notes that the quantity of data is "quite substantial."
Judge Torres: Then defense counsel must have the opportunity to review that information and determine whether to file motions.

She proposes Feb. 22 date to inform the court of possible motions.

No objections from the parties, with a caveat pending when discovery ends.
Costello asks whether there has been any Brady material.

AUSA Sobelman says he can answer that question offline, considering it relates to discovery.
Judge Torres:

"I wish everyone happy holidays and good health."

Adjourned. Just a scheduling conference.

The Supreme Court dismissed a lawsuit that would have blocked Trump's census-apportionment memo for lack of standing, a principle Trump vilified before that boosts him now.

This analysis of oral arguments held up.

Most of the myths and conspiracy theories about a free press in the United States would be demolished by anyone spending any significant amount of time in a press room.
Two reporters whose personal politics might be light years apart from each other can cover the same politically charged event and churn out extremely similar stories.

Because we covered the same happening.
Most beat reporters covering social institutions have integrity, and even if they didn't, the professional costs of burying news that damaged their perceived side or rewards to establish a record of credibility and scoops would be enough to set them straight.

BREAKING:

Judge Hall notes Georgia is at "halftime," far past the time for establishing new rules.

The plaintiffs did not exercise due diligence or show an injury in fact to establish standing.
Judge: The "motion to dismiss is GRANTED."

Attorney Amanda R. Callais, from Perkins Coie, is up for the Democratic Party of Georgia:

"That is quintessential speculative conduct of a third party."

"There has been no evidence, not even at the minimal standard... that there is any 'ballot harvesting' or 'voter fraud.'"
