What do the international texts say ?

It stated "the right to decide, the right to the information needed to make decisions clearly", "the patient must be able to understand the object of an examination or a decision", "the patient must be able to understand the purpose of an examination or treatment,
the effects of its results and the consequences of a refusal of treatment (art. 3a-b)".
The same recommendations were amended in Bali in 1995: "the patient has the right to refuse to participate in research or medical education", revised later in Santiago de Chile in Oct. 2005.

Moreover, they are clearly formulated in the "Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine" that was adopted by the Council of Europe, adopted on 4th April 1997, Oviedo.
The two essential articles are : Article 5, which states that an intervention in the health field can only be carried out after the person concerned has given free & informed consent,
And Article 10-2 on the right to information, which states : everyone has the right to know any information collected about his or her health.
That article adds that if the volition of a person is not to be informed, we must respect his/her decision.
