Balancing of the courts is badly needed. For far too many years, Republicans and Democrats alike have appointed mostly large-defense-firm lawyers and prosecutors, leaving out lawyers who’ve actually sought justice on behalf of Davids against Goliath. The resulting lack of 1/
understanding of what it means to represent individuals—the precarious economics, the procedural hurdles, and a general indifference to ensuring justice is done for ordinary people—often results in procedural unfairness and substantive outcomes that are unjust. Diversifying 2/
the judiciary to include far more people who’ve spent their careers fighting for justice for individuals and public-interest causes (think: Judge then Justice Thurgood Marshall) will bring balance and practical perspective to the courts at a time when it is most desperately 3/
needed.
Justice Marshall’s colleagues were reported to have valued the practical experiences he brought to their deliberations. So also, federal trial and appeals courts would benefit from having such experiences on the bench. Justice will be kinder, fairer—and most 4/
—most importantly—inspire public confidence.
Over my 25+ yrs as a lawyer, I’ve seen confidence erode that federal courts are guardians of justice.
We can restore justice if we demand judges who’ve spent careers fighting for justice for real people, not just corporations. 5/
Contact your senators (who make judicial-appointment recommendations to President Biden) and ask that they recommend and confirm lawyers who’ve fought for individuals, civil rights, and the public interest. 6/

2/ Talk to your accountant. If you run a small business or are an upper-middle-class professional, you are about to get hammered thanks to the @GOP, @SenBobCorker, @SenatorCollins, etc. You may think you're rich in their eyes—statistically you're right. But no.
3/ The @SenateGOP@HouseGOP@GOP is taking money from you—YOU, the real job creators—and giving $1.5 trillion to massive C-corporations. Country club Republican doctors, lawyers, accountants, small-business people who needed relief to expand? It's your pocket being picked.
