As the Senate Homeland Security Committee probes the Capitol siege, a detention hearing is just about to begin in the case against Oath Keeper Jessica Watkins.

Coverage ahead.

Speaking of the military-style "stack" formation seen at the Capitol (pictured here), the prosecutor says:

"The evidence at that stage is irrefutable" that Watkins was not only part of that "stack" but recruited other members of it.

Judge Mehta says he doesn't "necessarily buy" that Watkins is a serious risk of flight.
The judge asks for precedent on whether destruction of government property qualifies as a crime of violence, a question that he notes will impact many Capitol siege cases.
Most of the hearing has involved parsing precedent for this question, which could have broad ripples.

"These are issues that are not going to affect only Ms. Watkins but potentially dozens and dozens of others that are coming down the pipeline," Judge Mehta said.
Since this "threshold legal question" goes not only to Watkins' case, but many others, the judge calls for further briefing on the matter.

So there likely won't be a detention ruling in her case today.
That is to say, she will remain in jail pending further briefing on the matter.
After conferring with her client, Watkins' attorney Michelle Peterson agrees to the delay to brief these issues.

Before last week's outages, Houston had three 500-year weather events in the last half-decade. They didn't affect everyone equally.

Texas's biggest county's new top attorney, @CDMenefee, talks environmental justice, climate and ERCOT on my podcast. lawandcrime.com/objections-pod…
Perspective: Harris County's more populous than 25 states, and Menefee became its top civil attorney in November.

“What’s important here is, Harris County government’s changing,” @CDMenefee told me, citing his and @LinaHidalgoTX's elections.
Part of a wave of younger and more diverse Harris County leadership, Menefee steps into his role at a time of reckoning for ERCOT.

Menefee launched a probe of the embattled regulator today, as this news broke.

Follow along with me today.

Chairman Durbin just finished his opening remarks. lawandcrime.com/high-profile/m… via @lawcrimenews
Both Durbin and Grassley brought up Garland's experience prosecuting the Oklahoma City bombing case.

The debut of my podcast "Objection" interviewed attorney Aitan Goelman, who was on Garland's team in that case and spoke about the parallels with Jan. 6. podcasts.apple.com/us/podcast/was…
Pressed by Grassley on whether he spoke to President Biden about his son Hunter, Judge Garland firmed responded: "The answer to your question is no."

He added that POTUS's public statements about the AG's independence are why he is seeking the position.

According to this website, it's steadily restoring now back to ~515,000—and anecdotally, I'm back in power and will be reporting again today. poweroutage.us/area/state/tex…
Compared to millions here in Houston, my wife and I've had it easier than most.

Our power went out for ~32 hours, including one chilly evening spent bundled up. Data was spotty. Downed traffic lights made driving treacherous, & the city's still on a boil-water notice.
But we're healthy, have a bottled-water supply, and were reasonably prepared for an event that had little advanced warning.

One handy item that kept us informed when our devices were down: a crank radio tuned into Houston Public Media

"What you are about to hear has not been made public before."

One voice shouts: "They're throwing metal poles at us."
Now, Plaskett is rolling security footage of officers overwhelmed by assailants, including a man in full tactical body armor and a baseball bat.

Video to come.
Plaskett is telling the backstory of Officer Goodman, who was seen diverting the rioters.

At a Zoom press conference right now, @MassAGO Maura Healey notes the "turbocharging" language is McKinsey's own word in relation to sales. She says the settlement eclipses the money they made on the contract.
Healey notes McKinsey is a "big deal," given their clout in the government and private sector.

Other AGs on the line:

Colorado's top prosecutor Phil Weiser up now.
Weiser:

When others said maybe we should slow down the push for these deadly drugs, McKinsey didn't.

And when the probe heated up, the firm's partners deleted docs.

"These partners acted reprehensibly."

McKinsey says the partners were terminated.
