BREAKING: In High Court case of Oldknow v Evans, Mrs Justice Tipples has dismissed an application for a court order that would identify alleged leakers of Labour's internal anti-Semitism report.
Judge said that there was a real risk of innocent individuals being named and the case smacked of a legal 'fishing' expedition
Mrs Justice Tipples also said that she took into account the fact that there were two separate investigations into the leak: by the ICO and by Martin Forde QC.
In a submission on costs, lawyers for Oldknow say it now intends to pursue the party itself in the courts. Says she has been 'kept in the dark' and that Labour changed its position through the process.
Mrs Justice Tipples says that on costs, Oldknow had sought an "exceptional and intrusive jurisdiction" in her court order, and she has lost. Therefore she should pay the Labour party's costs.
Judge refuses application for appeal by Oldknow's lawyers.
The judge now also rules that Oldknow should also pay costs to @unitetheunion for their written submissions in the case.
Judge said Labour initially didn't oppose the application.
But matters moved on, "no doubt" because @unitetheunion lawyers Carter Ruck wrote to the party.

"We also welcome that the Court has ordered Emilie Oldknow to pay Unite’s legal costs for the making of those submissions, making clear reference to the importance of Unite’s intervention given Labour was not offering effective opposition to the Oldknow application.”
The Labour party is not commenting on the judgement.
