/ The High Court ruling on NUFCs arbitration objections is not a loss at all. To suggest the club are 2-0 down is just media sensationalism. In reality, the club and their legal team raised this objection knowing fine well it was a win-win situation and here’s why ...
/ Option 1 was the objection is upheld and NUFC push through a change in arbitration chair to somebody less ‘bias’. Obvious win. HOWEVER, and this is an important point, it can be argued that not having the chair overturned was actually their biggest win.
/ Knowing fine-well that as standard all judgements are publicly available (unless in the public interest to be kept confidential) NUFC and the legal team have forced scrutiny and pressure not only from the public but also from the judiciary and those involved in arbitration
/ process as a result of their statement. They have set their stall out and are essentially saying: “Okay so here’s an update on arbitration - the club do not agree with chair arbitrator and have challenged this. Unfortunately we’ve been unable to overturn this as judge doesn’t
/ See why this chair can’t act without bias. In essence, the judge is saying “we back the chair - but all eyes on him now to make sure there isn’t any bias and all decisions are watertight in law.” Don’t forget that he also gets a slap on the wrist from the judge for his
/ “error of judgement” in email communications with PL lawyers B&B. So what does it all ACTUALLY mean? Well ...
/ All eyes are on the chair now. He’s under intense pressure before the get-go. They’ve also cleverly used the judge of the High Court to narrow the point of this arbitration process right down to one vital point - ‘are PIF separable from the Saudi State in law?’ That removes
/ any issues which do not directly relate to this point as the judge himself has reinforced what the remits of this case are. With regards to wanting to make the arbitration process public, the club probably didn’t actually care too much about this but can now point to it
/ for two reasons: Reason 1: they AGAIN call the PL out for wanting to hide and redact facts. They very cleverly let us all know this in the club statement. Reason 2: the club have FINALLY recognised the importance of their fan base after 14 years of shitshow leadership.
/ let’s not forget - we hear VERY little from the club. This statement was premeditated before the challenge even went in. The club know this drives up a fan-frenzy and we’ve seen the influence mass fan hysteria can have when directed at institutions for being wronged unfairly
/ so what have we learned? Arbitration is about to start. The chair is massively under pressure to get this right. The PL are still trying to hide and conceal information. The club have already set out a strong case to appeal an unfavourable decision.
