Good morning! While waiting for bail reviews to start, here is our thread from yesterday’s docket of children being held in solitary confinement with no trials in sight.
On today's docket, Judge Jones presiding. ASA Cynthia Banks will be handling the bulk of the docket
Case 1: A postponement. Person who was released on jail home detention in December, but never actually released. Should be released today.
Case 2: A case taken off the docket as charges were dropped yesterday.
Case 3. A case resulting from police smelling marijuana. Now a young father who had a baby yesterday is stuck in COVID jail.
State: HWOB

Case 4: A teenager who was harassed by cops.
State: HWOB
Pretrial: Release
Judge: ROR
Case 4: Postponement because person is in COVID isolation. Reminder that "COVID isolation" in the jails is solitary confinement.
Case: Postponed at request of defense.
oops, that was Case 5 ....
Case 6: A person who has a small child that he is the only surviving parent.
State: HWOB

Case 7: A young father who was arrested based on a first name only from a witness. Was elsewhere at the time of the incident. Inconsistencies in the Statement of probable cause. 6 months between incident and arrest. And has now been held 10 months.
State: Claims inconsistencies in statement are due to jaw injuries. Yet Mosby's SAO claims #KeithDavisJr could speak after being shot in the face.
State: HWOB

Case 8: A young father with no court date set. The court is swiftly running out of trial slots as they are being taken up by 2019 cases. Late 2020 case might not get a trial until 2023.

Judge: Holding this case for a couple of weeks due to the state inability to have an answer to a basic question.
Case 9: A person who had a medical emergency while driving. When help arrived, they arrested him. Has multiple serious medical issues that make him more vulnerable to COVID complications.

Case 10: A young man on home detention expecting his first child. He needs to pay a lawyer to prepare a motion, then pay lawyer to be in bail reviews, all so judge can a write a sentence saying he is allowed to attend the birth.
All parties agree.
Case 11: ASA assigned to the case and the defense have agreed in writing to a release. ASA Banks is insisting on proof and is holding up bail reviews.

Case 12: Another expectant father.

Case 13: A person with severe health issues. Is being kept in an area where they have no running water.

Defense mentions that they are surprised SOC was allowed into the court system as it so incomplete and badly written.
Case 14: A person with an addiction issue. State recommends holding in COVID filled jail

Case 15: A father of 8 with sever medical issues that could intensify COVID reactions.
State: ROR

Case 14: Another Instagram case. Now a person is sitting in jail with a medical issues that could make COVID worse.

Case 15: A case that started with a traffic stop, no reason for the stop givin, no reason for search - not even the stretch of "a smell of marijuana"

Case 16: A young person who has been arrested multiple times by the same cop. In spite of the harassment, manages work, schooling young siblings.
State: Home detention
Pretrial: Home detention
Judge: ROR to pretrial supervision
Case 17: A young father on home detention who has a job that requires some travel withing the city and county. Is asking for step down to pretrial supervision.]
State: Would agree to a work modification but keep the box
Judge: On private home detention with work modification

Good morning. Bail reviews for children charged as adults are held on Thursdays. Pretrial doesn’t participate in these hearings. We remind you that these threads can be extra upsetting. The hearing should be starting in a few minutes.
Today in Baltimore City Circuit Court: Judge Jones is presiding. She reads the usual statement about remote proceedings, prohibition on recording.
CASE 1: a child who has been transferred among several jails and whose attorney is having a very difficult time meeting with him or even talking with him by phone. He and the other children in the jail he’s in now are in solitary confinement 23.5 hours a day.

CASE 1: a man who is being held in a jail that says they didn’t get notice of this hearing, so the man isn’t available by videoconference. Case is postponed.

CASE 1: A woman that has been incarcerated since October. Defense is seeking release, she has health conditions that put her at a high-risk for COVID and no trial date in sight. Defense details her living conditions, a dorm w/ no social distancing, no accurate COVID numbers.

Today in Baltimore City Circuit Court bail reviews: Judge Sampson is presiding. Sounds like ASA Linda Ramirez will be handling most of the docket.
CASE 1: a man who has been approved for Drug Court. The state has made an offer of probation. He has been in jail for 9 months, w/2 COVID-related postponements. He has children at home who were being taken care of by someone during his incarceration, and CPS has now removed them.

Today in Baltimore City bail reviews: Judge Sampson is presiding. Sounds like no defendants will be present.
Todd Oppenheim from OPD making a statement to be applied to all their cases on this docket. He’s addressing the factors in Judge Barbera’s order.
He notes the nationwide resurgence of COVID. Says trial dates in MD are “aspirational,” and defendants are not getting effective assistance of counsel.
