Hi @scotwomensaid @youngwomenscot @EHRC @EHRCChair @KishwerFalkner @RJHilsenrath @trussliz @GEOgovuk

I see you're advertising vacancies for your:

Young Women and Girls Advisory Panel on Tackling Unhealthy Relationships

womensaid.scot/recruitment-yo…

1/6
Given the role. it is understandable you state: "You must be a woman" so I assume you are declaring that it is an occupational requirement that appointees be of the female sex (and you therefore exclude males) as permitted under Schedule 9, Part 1 of the Equality Act 2010.

2/6
However, I note you go on to define what you mean by the term woman: "(cisgender, transwoman, gender non-binary or gender non-fluid person)"

3/6
None of these terms is used or defined in the Act but given that your list includes 'transwomen', can you say how you believe you meet the requirements of the Schedule 9 exemption to discriminate on the grounds of sex, particularly given...

4/6
...the definition in s.212 of the Act:

“woman” means a female of any age

5/6
Alternatively, can you confirm the vacancy is, in fact, open to both female and male applicants and that you are not restricting the vacancy to only those who are female?

Please respond.

Hi @bedspolice @BedsOPCC @EHRC @EHRCChair @KishwerFalkner @RJHilsenrath @trussliz @GEOgovuk

The 'Equal Opportunities' section in your job application has 'gender' in a list of the protected characteristics under the Equality Act 2010.

However...

'Gender' is not a protected characteristic under the Equality Act 2010 and is not defined in the Act.

Sex is the protected characteristic under the Act, but that is not on your list.

The purpose of this form is not entirely clear but as it is a part of your job application process, I assume its purpose is to help you to ensure that you are recruiting without unlawfully discriminating under the Equality Act 2010.

I note your 'EQUAL OPPORTUNITIES FORM' talks about the promotion of 'equality and diversity' and correctly includes sex as one of the protected characteristics...

Hi @mycafcass @EHRC @EHRCChair @KishwerFalkner @RJHilsenrath @trussliz @GEOgovuk

The 'Equal Opportunities' section of your job application mentions your statutory duties and has a partial list of the protected characteristics of the Equality Act 2010, but doesn't list sex

Hi @RosaForWomen @EHRC @EHRCChair @KishwerFalkner @RJHilsenrath @trussliz @GEOgovuk

I note you used this job application form last August so it may not be current.

However...
