New: Biden's first slate of judicial nominees is out, with a focus on diversity. His circuit picks include two former public defenders, and all are Black women:

- Judge Ketanji Brown Jackson, DC Circuit
- Tiffany Cunningham, Federal Circuit
- Candace Jackson-Akiwumi, 7th Circuit
Biden's district court picks include nominees who would be the:
- first Muslim American district judge (Judge Zahid Quraishi, NJ)
- first AAPI woman on the DC federal district court (Judge Florence Pan)
- first BIPOC woman on the Maryland district court (Judge Lydia Griggsby)
Finally, there's a nominee for DC Superior Court: Judge Rupa Ranga Puttagunta, a local administrative judge
For the DC federal bench, a few things to note:
- There are two DC Circuit vacancies, but only one nominee announced today, so that's another big one TBD
- Recall Rep. Norton had recc'd Jia Cobb for Judge Emmet Sullivan's seat –WaPo reports Judge Florence Pan (who had been nominated to the DC fed court under Obama) is being nominated for Jackson's future vacancy, so the Sullivan seat remains TBD washingtonpost.com/local/legal-is…
- Judge Florence Pan was one of three DC district court nominees the Senate didn't act on at the end of Obama's second term. The others were Judge Todd Edelman and Abid Qureshi (who we prev. reported were also under consideration for the DC bench again)

New: The DC Circuit has revived the detention fight over Capitol riot defendants Eric Munchel (the man photographed holding a bunch of zip ties) and Lisa Eisenhart: assets.documentcloud.org/documents/2052…

It doesn't mean they'll be released now, but will get another round in the district court.
In a 2-1 decision, the court found that the district court judge "did not demonstrate that it adequately considered, in light of all the record evidence, whether Munchel and Eisenhart present an identified and articulable threat to the community"
Importantly, the majority set some guidelines that will now apply to detention fights in all the Capitol insurrection and make it harder for the govt to secure detention if someone isn't charged with assaulting cops, breaking things, and conspiring/planning/aiding

Now: A judge has ordered Capitol riot def. Thomas Hale-Cusanelli, described by the govt as an "avowed white supremacist and Nazi sympathizer," to stay in jail. Judge gave weight to his history of violent, racist speech + comments *after* Jan. 6 expressing desire for civil war
Hale-Cusanelli had argued for pretrial release, with his lawyer focusing on the fact that he's not charged with assaulting anyone at the Capitol, and arguing that he hadn't acted with violence in the past on his documented history of hate speech
Govt argued the evidence showed Hale-Cusanelli's ideology had "escalated," that the court shouldn't wait for him to act on it to consider him a danger given the nature of what he's said, and that it's "naive" to think he's less likely to act now, given consequences of prosecution
