TN Advocate General Vijay Narayan declines consent to initiate criminal contempt of court proceedings against Thuglak Editor S. Gurumoorthy. Says some of his remarks could have been avoided but they do not scandalise the court 1/n

Mylapore broker Gurumurthy, on 14th January in an event in Chennai said, “All the judges in the courts, and the Supreme Court, have been appointed by politicians. Many [such people] fall at the feet of someone powerful through intermediaries to become judges. 2/n

This is something that we have to be ashamed of today. If judges were appointed on merit there would not be a situation of this nature”

Gurumurthy went on to justify his outburst against judges, claiming that the comments constituted an “extempore reply to a 3/n

provocative question”. The word “apology” does not find a place in Gurumurthy’s statement. Instead, he has sought refuge in words such as “error,” “regret,” and “unintended,” to explain his comments. 4/n

However, TN AG Vijay Narayan, who himself is a Brahmin finds this remarks of Gurumurthy pardonable.

Imagine if any non-Brahmin, or a dalit has made such remarks. 5/n

When Prasanth Bushan posted a photo of Bobde sitting on a Harley Davidson bike, the SC initiated contempt. On his reply to the contempt the SC Bench had this to say.

“The bench of Justices Mishra, B.R. Gavai and Krishna Murari had reserved its judgment on August 25, 6/n

after asking Bhushan multiple times to apologise for his tweets. Bhushan said he could not, in good faith, apologise, since he believed he had done nothing wrong, and his criticism was constitutional and valid. The bench was not satisfied with this response, 7/n

with Justice Mishra saying, “Tell us what is wrong in using the word ‘apology’? What is wrong in seeking apology? Will that be reflection of the guilty? Apology is a magical word, which can heal many things.” 8/n

The higher judiciary is the perpetrator and abettor for the onslaught of fascism today. 9/9
