In court hearing, an attorney for Jeffrey Sabol says he has “come to terms with the mistakes that he’s made.”
Sabol, he said said, realizes his “mindset on January 6 was completely wrong” and he’d “been lied to.”
Sabol claimed he was “patting [an officer] on the back” and saying “we got you man” when shown a video that appeared to show him throwing punches at an officer.
In Sabol hearing, federal prosecutor seems to reference the #SeditionHunters community and shows the court a "photograph disseminated across social media" that "very quickly kicked off” the probe that led to Sabol’s arrest.
U.S. District Court Judge Emmet G. Sullivan says he gets choked up every time he watches “shocking" Capitol battle footage.
“I was born in this city, been here all my life, and it’s hard to believe that that this type of conduct is taking place at the seat of our democracy."
Judge Sullivan then asked whether this battle took place at “the entranceway for Lady Gaga” during Joe Biden’s inauguration.
Prosecutor says she believes it was.
“I think the parties would stipulate to that, your honor,” defense attorney jokes.
NEW: Judge Sullivan is going to keep Sabol detained.
Couple other notes. Sullivan added that he and other judges are talking to the director of the D.C. Department of Corrections to try to separate "fact from fiction” about the experiences of Capitol defendants at the facility, where several say they were beaten by guards.
DOJ prosecutor also discussed questions about the origins and authenticity of the still photograph that helped set off the digital manhunt. She said she “watched countless videos” and hasn’t seen any video from that angle.
DOJ prosecutor noted that at trial the photo could be authenticated by a number of means, including confirmation from the person who took the photograph or someone in the photograph who admits the photo is a true and accurate depiction of what happened (which defendant has done.)
As @DianthaSol points out, other video appears to show Sabol brawling with police before the mob reaches the archway.
Phone records indicate he was in the area as of 3:29 p.m, per government.
