It is beyond patronizing to say that it's "cruel" to let people in because being in limbo for five years due to a broken immigration system is somehow worse that being completely blocked and left to the wolves.

Never forget that Andrew Sullivan, champion of immigration restrictions, committed immigration fraud to get a visa (lied about being gay, which was at the time a ground of inadmissibility) and used his connections to get out of a marijuana charge that threatened his green card. 
I actually support what the prosecutors did in that case (take immigration status into account) but I seriously doubt that Mr. Sullivan supports the government bending over backwards to preserve the immigration status of other people charged with crimes. archive.boston.com/news/local/mas…
And similarly, the fact that Sullivan lied about being gay to get a visa isn't a bad thing. No one should have had to deal with those bigoted laws.

In 1952 Congress almost passed a law that banned "homosexuals and sex perverts" from getting visas, but because doctors told them diagnosing being gay was difficult, they used different language.

I would hope that experience would teach him that nations *shouldn't* get the ultimate last say on who they admit, since he himself should have been barred entry.
