Story TK
SCHAFFER was charged for dpeloying bear spray at officers in one of the earliest waves of Capitol rioters, but he's planning to plead guilty to two charges: Obstructing the certification of the 2020 election, and breaching a restricted building. courtlistener.com/recap/gov.usco…
SCHAFFER's hearing was not announced on the court's public calendar, which Judge Mehta acknowledged was due to the secrecy of the proceedings. though he noted the call-in line was open to the public. He's now speaking privately with the parties before finalizing the agreement.
NEW: Jon Schaffer, a self-described Oath Keeper, is the first Jan. 6 Capitol defendant to plead guilty to participating in the assault. He's expected to cooperate with the government.
Prosecutors had inadvertently revealed that they were in "advanced" plea negotiations with Schaffer in an April 5 filing that was supposed to be sealed but ended up on the public docket instead. politico.com/news/2021/04/0…
MEHTA has determined that Schaffer is competent/capable of freely entering a plea deal. He's now going through details of the plea agreement with Schaffer before ratifying it.
It's unclear to me why many are reporting that Schaffer IS a member of the Oath Keepers. He put on a hat, but the local chapter has disavowed him and no evidence so far has connected him to the broader group charged for Jan. 6 actions.
NEW: The Capitol Police's riot unit is so dysfunctional that officers “actively find ways to circumvent getting assigned there," an internal watchdog found,
It's part of a scathing review of the department's readiness for the Jan. 6 insurrection.
UPDATE: Since our report that Trump booster Elliot Resnick was inside the Capitol on Jan. 6, several sharp-eyed readers have identified him in additional footage that adds context to his actions that day. politico.com/news/2021/04/0…
We now know that Resnick was in one of the first waves to breach the Capitol, entering the building around 2:26pm, before Pence was fully evacuated. Here he is (at 19:25) coming up the east front steps and appearing to wave on the crowd.
At 8:52 in this clip, Resnick lurches through the doors — while a cop tries in vain to stop the mob — with such force he falls forward. He then stands up and appears to head inside, but...
NEW: In late night filing, prosecutors appear to be increasingly confident that Oath Keepers stashed their firearms at the Comfort Inn in Ballston, VA. This would be the so-called quick-reaction force, or QRF, they referenced.
Oath Keeper point man Kelly Meggs also indicated the group sought out Speaker Pelosi.
And late on Jan. 6, dissension appeared to break out among Oath Keepers, including at leader Stewart Rhodes (person one)
IT'S FRIDAY: After staring long enough at spreadsheets of the 300+ Capitol defendants, I couldn’t unsee some of the themes in their names. So I thought I'd share some of them. Apologies in advance.
For those inclined to MUNCHEL on something SWEET, try the HONEYCUTT ORANGIAS with a swig of STRONG COFFEE. Unless you'd prefer BAKED ALASKA
There's a set of Capitol defendants for animal lovers too: COLT, LYON, LYONS, STURGEON, MINK, FAIRLAMB, FISHER and GRIFFIN, as well as other assorted livestock found in BARNES
NEW: In February, Elliot Resnick scored an interview with Trump impeachment lawyer David Schoen. In March, he wrote an op-ed defending the Capitol riot.
Resnick, chief editor of the New York-based Jewish Press, is best known for commentary denying the existence of white nationalism, denouncing LGBT people and calling African religions “primitive.”
Lately, he’s defended Trump claim the election was stolen
Footage during the Capitol attack shows Resnick crossing the rotunda and approaching a Capitol Police officer as the officer is being accosted by a group of rioters.
Even those who weren’t physically injured on Jan. 6 have described haunting hand-to-hand encounters with rioters, some hurling racist epithets, others brandishing tasers, knives and bats to threaten them.
Since Jan 6: The force has faced intense scrutiny and an IG’s rebuke, 34 officers are under internal investigation, one died by suicide, two are suing Trump. All amid a Covid crisis that has taxed frontline workers like police more than most.
