The last two days in the UK were highly important for sex-based rights. We, as LGB people who know that sexual orientation is towards sex and not gender identity, care about it.
Recently, it has been criminalized for especially lesbians to situate their sexual orientation based on sex instead of one’s subjective and declared gender identity.
We already stated how this conception made us vulnerable to abuse, and how it was no different than conversion therapy. Homosexuality is one of the spheres in which sex is important. That’s why it’s very important for sex to be a protected characteristic.
In @MForstater case, the judge had previously ruled that a fact, that sex is distinct than the subjective gender identity, it was immutable in humans due to its biological character++
++ and determined by having shorter or longer gametes -producing either egg or sperm-, thus dimorphic wasn’t a protected belief. Maya Forstater’s business contract was refused to be renewed because++
she called a person -whose sex was male- a man without knowing that they identified as NB and preferred to “dress as a woman” only on some days of the week.
Maya Forstater also said that she would, out of courtesy, use people’s preferred pronouns in the workplace and other public spheres, but believes that biological sex is distinct from gender identity and is important in some respects.
In yesterday’s appeal hearing, this was reminded to the judge. The most important development in the hearing was that the EHRC -Equalty and Human Rights Commission- intervened in the case in favor of Forstater.
According to the EHRC, the judge has made the wrong decision in the first hearing. hiyamaya.files.wordpress.com/2021/04/forsta… The judge, after hearing the defendant and interveners, decided that the final verdict will be announced in a few months.
We know that in one respect why biological sex is important is that it is crucial in our fight to protect the rights of lesbians and gay men. Thus, we want to show solidarity with Maya Forstater’s case.
Unfortunately, as a result of the growing tendency to define sexual orientation on the basis of gender identity rather than on the basis of biological sex, we have witnessed how the mainstream LGBT community started to harass lesbians into accepting sex with people with penises++
