THREAD: Don't take the feds at their word when they say a US Capitol Insurrection defendant is being "monitored" prior to trial.
Judge has ordered prosecutors to update her by Friday about what's going wrong with the monitoring of Daniel Egtvedt
Egtvedt is accused of grabbing at police on Jan 6 and disregarding orders.
Judge released him weeks ago saying "Being a jerk, a loudmouth and belligerent" was not reason to hold Egtvedt
But his release didn't go as planned
In court filings, prosecutors say the court's probation office couldn't properly equip Egtvedt with electronic monitoring devices. They didn't work at the home in which he's staying around remote Garrett County, Maryland.
So he's been "un-monitored" for two weeks ==>
New equipment is ordered. But hasn't arrived yet.
Prosecutors asked a judge to revoke Egtvedt's release and return him to jail.
Court's pretrial services team says new device should arrive tmrw. Update ordered by judge on Friday

The LITERAL cost of the US Capitol riots. I spotted this in a report from the DC Police Department to the DC Council ====>
DC Police needed to buy more pepper spray and tear gas. And a LOT of it!
Yes.... this is one reason why ===>
I asked DC police about the ten-fold increase from 2019
DC Police: "The increase in acquisition of OC Spray reflects both the increased occurrence of rioting so far this year (including Jan 6), as well as general preparations for possible civil disturbance the rest of the year"
Arraignment at 10am for Delaware man accused of bringing *Confederate* flag into Capitol on Jan 6
Initial court appearance at 1pm for Logan Grover of Colorado, who is accused of being in this wave of the mob near broken doors and windows at US Capitol on Jan. 6. Feds say Grover referred to 2020 election as "insane... treasonous insurrection"
I'll be closely monitoring the 12pm court hearing for accused Proud Boy & Capitol riot defendant Ethan Nordean. Nordan's accused of conspiring to organize the mob and allegedly said police are "part of the problem." He's challenging his pretrial detention to Court of Appeals
Overnight... the Justice Dept notified a judge they have additional phone records for US Capitol Insurrection defendant Brad Bennett of North Carolina. Bennett allegedly got inside the Senate chamber & is linked to Q-Anon.
Bennett's case is different than the others...
Feds say Bennett made his intentions clear on Jan. 2... changing his profile picture to read, “FAIR WARNING. IF THIS ELECTION IS STOLEN FOR BIDEN . . . PATRIOTS WILL GO TO WAR"
But it's what happened AFTER Jan 6 that's convinced the feds to ask Bennett be jailed
Prosecutors say Bennett suspected his arrest was imminent in March... and took off. Disabling his phone and connecting to the rest of the world through fast-food restaurant WI-FI
THREAD: We're reaching a new chapter in the prosecution of accused US Capitol Insurrectionists
And it's illustrated by the court filing Friday night from Robert Gieswein, who's accused of wearing riot gear, wielding a baseball bat on front lines & wielding Anti-Semitism too
In Gieswein's case (and many others) - the feds have sought extra time to proceed with the prosecution because of the tonnage of cases and evidence.
This week - for the first time - the Justice Dept indicated total arrests could top 500
But Gieswein's new court filing says he doesn't wanna wait for his case to be heard.
For a few reasons. He's been locked up for months - and doesn't wait to wait in jail much longer
Of the thousands of pages of court filings we've read from US Capitol Insurrection prosecutions .... one motion today is among the most interesting.
Chris Worrell of Florida, who suffers non-Hodgkins lymphoma wants to be released from jail. But........
Worrell said he's worried he'll die from COVID in the DC jail
DC's chief judge denied him. Among other reasons, judge cited the fact that Worrell wasn't wearing a mask amid the mob on Jan. 6.. and didn't seem terribly concerned about COVID or his health during the Insurrection
Today, Worrell appealed to DC Court of Appeals... and makes this striking argument:
Worrell argues *he* has a right to disregard the science about masks and COVID... but says the judge does NOT
