The report looks at 10 yrs of immigrant Habeas litigation in La. from 2010-2020, that’s 499 cases. Notably we found chronic delays: detained immigrants typically endured nearly 1 yr & 1 month before filing the case & then had to wait an avg of 6 months more for a decision
We also found serious challenges for access to counsel: 85% or detained immigrants must file their Habeas case on their own, navigating the maze of procedural requirements like the court-mandated form & filing a fee waiver or paying the $5 filing fee
We found disturbing racial disparities: Black immigrants represented more than half of detained immigrants filing for Habeas even though though a @BAJItweet study found Black immigrants make up only 4.8% of detained immigrants in removal proceedings baji.org/wp-content/upl…
