Hi @Scottish_Squash @EHRC @EHRCChair @KishwerFalkner @trussliz @GEOgovuk

In your 'Member Equality Survey', you say "This work is being carried out as part of our responsibilities under the Equality Act 2010"

forms.office.com/Pages/Response…

1/11
In the list of what appears to be the protected characteristics under the Act you (rightly) list sex but you also list 'gender identity'.

2/11
'Gender identity' is not a protected characteristic under the Equality Act 2010 and is not defined in the Act.

legislation.gov.uk/ukpga/2010/15/…

3/11
You ask, "Are you" with options:

Male
Female
Non-binary
I prefer not to say
Other

4/11
It is not clear if you intend this question to be asking for the sex of the individual or something else because although female and male are the terms used and defined in the Act for the two sexes, 'non-binary' is not a sex or a term used or defined in the Act.

5/11
'Other' would also not be a valid response.

6/11
You then ask, "Do you or have you ever identified as transgender"

7/11
'Transgender' is not a protected characteristic under the Equality Act 2010 and is not defined in the Act.

legislation.gov.uk/ukpga/2010/15/…

8/11
There is a protected characteristic of 'gender reassignment', but the terms you use here are not used or defined in the Act and you have not included that in your list of protected characteristics.

legislation.gov.uk/ukpga/2010/15/…

9/11
You might also like to take note of what employment and discrimination Barrister Akua Reindorf said in her report on the @uni_of_essex and in particular Recommendation 18:

cloisters.com/reindorf-revie…

10/11
Will you undertake to correct these errors and to review all your other policies, documents, reports, etc to ensure compliance?

Please respond.

Hi @UKParliament @HouseofCommons @UKHouseofLords @EHRC @EHRCChair @KishwerFalkner @trussliz @GEOgovuk

The 'Diversity Monitoring' in your job application talks about "recruiting a workforce that reflects the diverse communities that we serve".

1/25 ImageImage
As it is a part of your job application process, I assume its purpose is to help you to ensure that you are recruiting without unlawfully discriminating under the Equality Act 2010.

I also note the @EHRC guidance on this:

Good equality practice for employers: equality policies, equality training and monitoring

Hi @SCTScourtstribs @EHRC @EHRCChair @KishwerFalkner @trussliz @GEOgovuk

Your 'Equal Opportunities' section in your job application says you use the information 'to monitor the effectiveness of our recruitment campaigns'.

Hi @tradegovuk

Now that @trussliz has called for all government departments to withdraw from @stonewalluk’s 'Diversity Champions' scheme and after @EHRC announced it had already left, will you take this opportunity to review your equality...

... monitoring and all your equality policies, etc to ensure they accurately describe the Equality Act 2010 protected characteristics, particularly after what employment and discrimination Barrister Akua Reindorf said in her report?

I have highlighted many Government ministerial & non-ministerial departments on my website, mostly for using the term 'gender' instead of the protected characteristic of sex in their recruitment monitoring (October 2020):
