“There’s a massive grassroots effort to oppose these proposed regulations and we know our tools are being used aggressively to help spread information and awareness,” @gunpolicy's Adam Kraut told me of the backlash to the ATF's pistol brace ban plan. thereload.com/americans-floo…
“The change of this law, which has precedent established, without legislation or judicial oversight is not only unconstitutional, but abjectly immoral,” one commenter said. thereload.com/americans-floo…
Some were more succinct with their criticism. “Unconstitutional,” one anonymous commenter said. “SHALL NOT BE INFRINGED,” another said. thereload.com/americans-floo…

The ATF wasn't able to answer all of my questions about the pistol brace ban and suggested I submit them as a public comment. If you want to read my full comment, you can get a Reload membership and check it out here: thereload.com/heres-what-i-a…

This is a great way to get yourself arrested and charged with a federal felony. This stunt didn't work for Kansas and it's unlikely to work for Texas or states.
If someone wants to violate the NFA in order to challenge its constitutionality in court they should do so knowing the possible negative outcome (years in federal prison). These state laws give people a false sense that what they're doing won't get them in serious legal trouble.
It's one thing to say you won't use state or local resources to enforce gun laws you don't agree with. It's another entirely to suggest your state or local law can protect people from federal laws. That's a legal theory people shouldn't unknowingly bet their life on.
The Senate Judiciary Committee will vote on President Biden's ATF nominee today. It's likely the vote will tie and his nomination will likely remain in the committee. If the Democrats move to discharge him to a full floor vote it will mean they are confident he has 50 votes.
Nearly 37,000 comments have been left on the pistol brace ban proposal after just 5 days. That's tens of thousands more than ever get left on most rule change proposals. The comments are overwhelmingly negative. thereload.com/americans-floo…
“This is the most arbitrary set of rules I’ve ever heard of,” one commenter said, “and you’ll just make millions of normal Americans into felons despite a complete lack of evidence that these braces are a problem.”
Almost 37,000 comments have been submitted on the proposal to ban/register in the 5 days since it went live. They appear to be uniformly negative. I detail what some of them say here:
“This is the most arbitrary set of rules I’ve ever heard of,” said Jack Ort, “and you’ll just make millions of normal Americans into felons despite a complete lack of evidence that these braces are a problem.” thereload.com/americans-floo…
The overwhelmingly negative comments could lead to the proposal being pulled. Other controversial gun proposals have been pulled after the public comment period. thereload.com/americans-floo…
