I am back this morning in Santa Ana for another round of the #MichaelAvenatti embezzlement trial! Judy Regnier, a former Eagan Avenatti LLP paralegal, is still on the stand under cross examination.
Judge Selna has dismissed a juror who called the court last night saying his roommate had a cough and was congested. The juror said he was concerned his roommate might have COVID-19.
There are still three alternates on the jury.
Avenatti is walking Regnier through his past cases at Eagan Avenatti that also settled, asking her if those clients complained of not receiving their money.
She said no.
Avenatti has just ended his cross by reiterating that attorney fees, expenses and advances are taken out of a settlement before the client gets their share.
Regnier agreed.
And after nearly 3 full days of testimony, Regnier has left the stand.

In early 2017, Weiner said the parties spent a very long day negotiating a settlement between Gardner and Whiteside
Whiteside agreed to pay Gardner $2.75 million in the first payment and another $250,000 in a later payment, with all money going into Eagan Avenatti's client trust
Once the settlement was signed but before the deadline to pay, Avenatti repeatedly asked Weiner when the wire would be coming though.
Weiner said there was no issues with the settlement.
“He was just anxious to get the payment.”
In one voicemail played in court, Avenatti tells Weiner he and his client are "growing increasingly worried and anxious that this thing is going to fall apart.”
Weiner said at that point the money wasn't yet due and his client hadn't done anything contrary to the agreement

Avenatti is now asking about the payment deadlines under the agreement
