McFadden scolded DOJ for arresting first, building case much later. Nearly 7 months after first arrests, DOJ admits full trove of digital evidence, which may include exculpatory evidence, isn’t available to defendants. But it isn’t stopping DOJ from demanding pre-trial detention.
Hale isn’t charged with any violent crime. He was arrested Jan 15 after 5-hour voluntary interview with FBI. An egregious case—he’s been behind bars since his arrest. McFadden, now worried about constitutional violations, denied his release in March.
Hale was turned in by a colleague who wore a wire to record a conversation about “civil war.”NCIS interrogated nearly 4 dozen co-workers about Hale’s “white supremacist” views.

Now listening in on status hearing for Tim Hale-Cusanelli. Judge McFadden presiding. He's been behind bars since January, faces no violent charges. Wrote about the case here:
DOJ: Plea offer extended after last hearing. Government didn't hear back from defense attorney because he cannot get a hold of Hale in DC jail. "Cannot meet with his client or hear from his client." This DIRECTLY CONTRADICTS what DC DOC said in a statement yesterday.
DOJ wants Hale to plead guilty to felony count of obstruction. "If we do set a trial date, the government cannot meet discovery obligations until early 2022." That's a conservative estimate, she says. Slow-walking discovery to force defendants into plea deals. "We need time."

Wrap-up. Robert Morss, arrested June 11 now held in DC Deplorable Jail, will remain behind bars until trial/plea. Judge Harvey litigated his case in court today, referred to J6 protesters as "rioters" and scolded Morss for using his military training "for political violence."
So Deplorable Jail has another permanent detainee, Biden's DOJ has another scalp, DC court treats another pro-Trump American treated differently than Democratic activists. And another life/family ruined.
