US Justice Dept is requesting 2-month prison sentence for one of the (growing number) of Jan 6 defendants who are pleading guilty to the lower-level misdemeanor of "unlawful parading"

Justice Dept filing: "A lesser sentence would suggest to the public, in
general, and other rioters, specifically, that criminal acts in support of a political cause are a crime
which will go without serious punishment"
What's distinctive in this case?

Feds included this language in sentencing memo: "Although (Reeder) has pleaded guilty to Parading in the Capitol he appears to be proud of his participation in the attack on the United States Capitol"
Note this statement from federal prosecutors about Reeder.... who they say spent TWO HOURS unlawfully on the grounds on Jan 6 ===>
"Unlawful Picketing/Parading" has become the boiler plate misdemeanor plea agreement in lower-level cases.

So far, none of those who've pleaded guilty to the charge have been sentenced to prison.

Reeder would be the first, if judge goes along with DOJ request
In Reeder's case, federal prosecutors added this note when asking for prison sentence in his case...

"The defendant chose to stand among the crowd and record as they yelled “Hang Mike Pence.”
Federal prosecutors:

"A clear message must be sent to this defendant that he is being held responsible for all of his illegal conduct during the riots. Tellingly, (Reeder) continues to minimize his conduct...as an “accidental tourist with a phone trying to document everything”

Court hearings starting now in case of Ryan Samsel, who is accused of knocking officer unconscious on Jan 6 and of history of accusations of beating other women

Samsel is jailed, but just underwent medical procedure at Virginia hospital.. more info coming.. standby
Samsel has some complaints and concerns about medical care available to him in jail. He had appointments today at Univ of Virginia hospital to see a vascular surgeon. Possibility that surgery is needed; per correctional officials. Doctor report expected Monday
Ahhh… per judge, today’s medical appointments are a “second opinion”… first opinion was that there was no need for surgery for Samsel

Judge says, “Let’s collect more data”…. Another hearing in a couple of weeks. Samsel stays in jail

Feds allege Lazar said, "F** the tyrants. There’s a time for peace and there’s a time for war” .. and used chemical spray on police while wearing tactical gear..& yelled "forward" to hundreds of rioters
Feds also allege Lazar yelled at police thru bullhorn: "Stand the f*** down... get the f*** out of the way, tyrants!”

Feds also accuse Lazar of saying this on video: "They maced us, those tyrannical pieces of sh**, and we maced them right the f*** back and now they’re taking the building.”

Boyd Camper of Montana is accused of filming w/ Go-Pro camera while in Capitol

This type of plea deal hasn't yielded prison so far
When asked by judge, Camper acknowledges seeing barricades toppled, knew he wasn't supposed to be there, says he was "caught up in the moment"... "followed the crowd'
When asked... Camper tells judge he had "no objective" when entering Capitol on Jan 6.... again says he was caught up in moment, alleges police were watching mob walk in.. "I just simply walked up to Rotunda"

He's pleading guilty, yet arguing to justify actions

Starting now: Sentencing in the Jan 6 case of Josh & Jess Bustle of Virginia. Not accused of damage or assault. Feds are gonna recommend "home detention" (slightly more for Jess, citing her social media posts about Pence)

Let's see if judge goes higher and orders any prison
Interesting: Judge just said there shouldn't be a presumption of probation in these Jan 6 misdemeanor cases. Raising the bar for defense lawyers here
Prosecutor: "This is not a minor crime.... The riot was an attack on the legislative seat of the United States.. and transition of power between Administrations"

"People should not assume probation is going to be the default."
