You hear me talk A LOT about white supremacist infiltration of law enforcement and the military — and about how difficult the problem is to track.
So I figured I’d fill you in on at least one reason why:
Plea bargains.
IIRC, approximately 10% of criminal convictions are secured through jury trials - 90% result from negotiated plea deals.
Why does that matter?
Media coverage.
There’s a reason so many of you “don’t believe this is a real threat / never heard of this issue before.”
The plea bargain process (like the criminal justice system in general) is deeply broken - not just for white supremacist police and military personnel.
But RE those particular cases - no trials, no media coverage - the American public has no idea of what threats actually exist.
Here's an odd (but useful) "workaround" - yes, methodologically, it's far from perfect (but I'm not a quantitative scholar anyway) but it's wildly informative:
Appeals court files from convicted white supremacists who took pleas, as well as the lawsuits they file while inside.
Primary source material exists on convicted white supremacists in the military and law enforcement (albeit in pain-in-the-ass places - and we need to think about why that is).
Anyway, what I'm saying here is:
Get creative.
I've found several lawsuits filed by white supremacists over the First Amendment right to receive propaganda (like Metzger's W.A.R.) behind bars.
For example: today I'm working on a case from the United States Disciplinary Barracks, Fort Leavenworth.
