what is the limiting principle for allowing states to evade federal protection clauses by using private actor enforcement? there is literally none as it stands today. the supreme court effectively abolished itself, one suspects by design
if states can do this without federal scrutiny, why would states pass laws using any other mechanism?

as I said before, this is about abortion at the top level; the actual objective is removal of any federal checks on a state’s justice system. a supreme court that would allow this is a supreme court which is already defunct. add seven more seats or dissolve the system
