Big hearing today in Oath Keepers case. Two motions on the schedule - change of venue and motion to dismiss obstruction of official proceeding count.

First trial date is set for end of January for detained defendants. Five Oath Keepers are behind bars awaiting trial, some have been in jail since January. Accused of no violent crimes.

Mehta addressing Ken Harrelson -- John Pierce was his attorney. He's been MIA.
David Fischer is Thomas Caldwell's attorney. He has filed a lengthy motion that argues obstruction of an official proceeding did not apply to Electoral College certification. Other attorneys have as well.

There is zero change Mehta will dismiss this charge.
DOJ has charged about 200 defendants with obstruction -- it's a felony punishable by up to 20 years in jail. It's been added to mostly misdemeanor cases like Jacob Chansley and Paul Hodgkins who both pleaded guilty to obstruction.

Judge Moss last month warned DOJ the charge suffered from a "constitutional vagueness problem."

The qualifier "knowingly corruptly" in the statute is another snag for DOJ. This statute was passed in 2002 in response to Enron scandal - when GW Bush signed it, he explicitly warned it was not to be used against political protesters.
Mehta accused defendants of "crossing barriers, rushing past police to enter the Capitol with the intent to obstruct an official proceeding."

(They haven't been convicted. You see where this is headed.)

NO DUH that's the point.

Kavanaugh protesters got slap on a wrist for doing same thing in October 2018.
These judges DO NOT want to hear comparisons to Kavanaugh protests. Activists had the same objective - to halt official business of Congress.

Lawyer: This has never been applied to a demonstration in 20 years.

Very dangerous precedent here.
Mehta turns to DOJ to defend obstruction charge. It is unambiguous, prosecutor says.

"I wish it were that simple," Mehta says. Notes statute born of corporate crime, Enron. It's a "stretch" to go from document shredding to activity on January 6. 1512 is tampering with evidence.
Mehta: "This resembles nothing like the shredding of documents."

"There is no limitation to what 1512c2 can cover?"

DOJ: No.

WHOA.
Mehta: Very different than destroying documents, tampering with a witness.

DOJ: They were trying to intimidate Congress. LOL.

Mehta asks if someone came in to interrupt court hearing, could they be charged with 1512c2?

DOJ: Yes.

Caldwell lawyer again noted no one has been prosecuted under this statute for this type of conduct.

Oath Keepers status hearing. DOJ says it’s making “progress” on discovery. Lol FBI put together still shots of USCP surveillance video for defense. DOJ does NOT want that video made public or even to defense. Just amazing.
Reminder that DOJ and USCP have total control over 14,000 surveillance video from January 6. In a recent update, DOJ said half the footage was not relevant to J6 investigation.
Judge Mehta asking if defense will be able to access video for a specific area of the Capitol.

He says it’s “critical” for defense to access video. The legal battle for USCP footage will be huge.

As we mourn the murder of nearly 3,000 Americans while taking our lives back to that horrific and heartbreaking day 20 years ago, I wonder how many feel how I do.

Unlike 20 years ago, I believe the biggest threat to America doesn’t exist outside our border. It resides here.

Look no further than the collaboration between every powerful interest in 2020 to oust Donald Trump. When the folks in charge hijack one of our most sacred rights, then brag about it in plain sight, what’s more threatening to our democracy than that?

Jacob Chansley, the most famous J6 protester, pleads guilty to obstruction of an official proceeding, a felony.

Last J6 protester to plead guilty to same charge sentenced to 8 months in prison.

Chansley, with no criminal record, will now be a convicted felon.

I cannot wait until the next massive protest in DC when leftist activists occupy a building to stop official Congressional business. Think those people will face felony charges? No way.

Plea hearing up now for Jacob Chansley, the so-called QAnon shaman. Checked docket this am and no filing about plea arrangement. My guess is guilty to obstruction of an official proceeding charge.

Chansley has been incarcerated for almost 8 months, mostly I solitary.
Chansley isn’t accused of any violent crime. Judge Lamberth, an obviously cruel man who needs to retire, refused to release Chansley after last hearing even after lawyer detailed Chansley’s deteriorating mental health.

Biden: Bragging about airlift, "double what the experts said we could."
