Oath Keepers status hearing. DOJ says it’s making “progress” on discovery. Lol FBI put together still shots of USCP surveillance video for defense. DOJ does NOT want that video made public or even to defense. Just amazing.
Reminder that DOJ and USCP have total control over 14,000 surveillance video from January 6. In a recent update, DOJ said half the footage was not relevant to J6 investigation.
Judge Mehta asking if defense will be able to access video for a specific area of the Capitol.

He says it’s “critical” for defense to access video. The legal battle for USCP footage will be huge.
Public defender’s office says there’s “no way” they’ll be ready for trial in January. First trial date is January 31 for detained defendants including Jess Watkins, Kelly Meggs, Ken Harrelson.

They’ve been in DC jail since February. Mehta asking about logistics for detainees.
DOJ says it’s very hard for detainees to get access to their evidence in their case.

DOJ also says January trial is “unrealistic.”
Mehta says he’s not ready to move trial date. Notes they will have been in jail for 11 months by time trial starts. Says discovery doesn’t relate to these 3 detained defendants—raises Speedy Trial Act issue.

Mehta: Government needs to prioritize discovery for January trial.
Keep in mind, these 3 are not accused of a violent crime. This is optics detention ONLY.

DOJ wants to keep them behind bars and Mehta is keeping them there for now. Big talk about “liberties” but please.

Mehta says COVID restrictions limit multi-defendant cases. (There are 18 Oath Keepers in this case.) He mentions trials extending into 2023.

Crowl’s lawyer complaining about discovery. She’s concerned about a superseding indictment bc number of unindicted co-conspirators.
Jessica Watkins lawyer says they won’t be ready for January 31 trial date. She isn’t able to work with her client bc she’s detained. (She is transgender).

Soooo Watkins is behind bars since February. No violent charge. Lawyer can’t access her to help build defense.
Now Harrelson new attorney says he won’t be ready for January 31 trial. Concerned about access to Brady material.

“My client is under lockdown, out 5 hours a day. He looks terrible. He can’t get a shave or a haircut. Worried about his medical condition.”
“I’ve seen my client for 5 minutes.”

Mehta says he’ll wait until NEXT status hearing to decide what to do. Blames Harrelson for 3rd lawyer. (He had John Pierce.)

Unbelievable. Unconstitutional and inhumane.
Another defense lawyer says she hasn’t seen any cell phone evidence from unindicted co-conspirators.

Another lawyer wants audio not just video from body camera footage. USCP surveillance video doesn’t have audio.

DOJ has eliminated audio on some publicly-released body cam video
Another lawyer upset about Brady information. “There’s Person One, we all know who they are. We need to know yesterday who those people are.”

He’s very upset about Brady material.

Mehta says Brady cannot be withheld until trial.
He’s still defending DOJ.

Lawyer asking now for names of unindicted co-conspirators. Mehta says send government an email. JFC.
Mehta suggesting January trial date will be replaced with April trial date. April trial moved to July. (Oh gosh that’s not gonna work, Mehta says to himself.)

What a sh*tshow this is.

Next hearing October 14.

Mehta AGAIN excludes time on Speedy Trial act.

Now maybe @alanfeuer knows something I don’t. Please disclose how many protesters who’ve disrupted Congress were held behind bars for MONTHS on an obstruction charge. Especially under a statute aimed at interfering in Congressional investigations not a political protest.
Now @alanfeuer won’t engage me because that propaganda is aimed at gratifying the bloodlust of NYT readers. It’s not up for serious debate. Maybe Alan can explain how it’s ok to keep nonviolent defendants such as Watkins, Meggs, Harrelson, Hale at DC jail for several months?

Jessica Watkins was arrested and charged in January for nonviolent role in Capitol breach probe.

Her congressman?

Jim Jordan.
Kelly Meggs arrested in February. He’s been detained ever since.

His congressman?

Republican @DrNealDunnFL2.
Ken Harrelson arrested in March. He’s been detained ever since. His lawyer today said he looks terrible, can’t get a shave or haircut, has a medical condition.

As we mourn the murder of nearly 3,000 Americans while taking our lives back to that horrific and heartbreaking day 20 years ago, I wonder how many feel how I do.

Unlike 20 years ago, I believe the biggest threat to America doesn’t exist outside our border. It resides here.

Big hearing today in Oath Keepers case. Two motions on the schedule - change of venue and motion to dismiss obstruction of official proceeding count.

First trial date is set for end of January for detained defendants. Five Oath Keepers are behind bars awaiting trial, some have been in jail since January. Accused of no violent crimes.

Mehta addressing Ken Harrelson -- John Pierce was his attorney. He's been MIA.
David Fischer is Thomas Caldwell's attorney. He has filed a lengthy motion that argues obstruction of an official proceeding did not apply to Electoral College certification. Other attorneys have as well.

There is zero change Mehta will dismiss this charge.

Jacob Chansley, the most famous J6 protester, pleads guilty to obstruction of an official proceeding, a felony.

Last J6 protester to plead guilty to same charge sentenced to 8 months in prison.

Chansley, with no criminal record, will now be a convicted felon.

I cannot wait until the next massive protest in DC when leftist activists occupy a building to stop official Congressional business. Think those people will face felony charges? No way.

Plea hearing up now for Jacob Chansley, the so-called QAnon shaman. Checked docket this am and no filing about plea arrangement. My guess is guilty to obstruction of an official proceeding charge.

Chansley has been incarcerated for almost 8 months, mostly I solitary.
Chansley isn’t accused of any violent crime. Judge Lamberth, an obviously cruel man who needs to retire, refused to release Chansley after last hearing even after lawyer detailed Chansley’s deteriorating mental health.
