Adv Prashant Bhushan said that your lordships had directed that the Backup examination should be allowed to the people who were unable to attend the examination.
What they have done is you can take the examination when the next regular examination comes up that is in November.
What will happend as a result is that these people who were unable to give exam in July will loose one attempt, Bhushan added.
They should be directed to hold a backup examination.
Sr Adv Ramji Srinivasan, there will be no loss of opportunity to the candidates.
It will not be treated as an attempt at all, all benefits that were supposed to be given will be there, Srinivasan added.
Court asked How many students are there.
There are 1000s throughout the country, Srinivasan responded.
Court asked whether it will be possible to conduct another examination on the old syllabus?
Srinivasan- Milords I'll take instructions on whatever has fallen from your lordships.
We'll stick to our usual cycle.
Court- but this November they will appear and in the next one more examination be there on the old syllabus, we are not disturbing your cycle.
Srinivasan responded that We'll do that.
However, Bhushan said that last time they conducted a seperate examination.
Bhushan added that Milords when these students passout they are considered as a passout of a specific year. I should be given my seniority.
The Court said that on this you file representation to the institution, they are very open
Court order, we do not wish to continue this WP further, appropriate decision in the best interest of the candidates will be taken, We direct petitioner should make representation on the other issues and the same be responded through Mr Srinivasan by ICAI within 2 weeks.
