The Rajasthan High Court has denied police protection to a couple of a widow and a married man whose first marriage was still subsisting and valid.
The couple moved Court in a petition under S.482 CrPC seeking protection of their right to life and personal liberty.
The woman had lost her husband and was since living with her 3 children. The man had been living separately from his wife. They got married earlier in June.
Refusing to grant the petitioners any police protection, the court noted that as the man was already married and had not obtained divorce, his first marriage was still subsisting. As such, even though the petitioner woman was a widow, her marriage with the married man was void.
The court held that their relationship does not qualify as a legally recognized #livein relationship, rather is a "purely illegal and unsocial relationship" and that "granting police protection to such a relation would amount to validating their illegal relationship."
The court highlighted that granting police protection to the couple would amount to granting acceptance to a relationship which is wholly illegal.
The bench of Justice Satish Kumar Sharma concluded by stating that if their is any illegality or crime against the petitioners they are free to approach the police to exercise their legal remedies.

Delhi High Court denies bail to two accused persons in #DelhiRiots case of violence against the @DelhiPolice in which HC Ratan Lal lost his life.
Noting that the footage of the two accused persons at the "Scene of Crime is quite egregious," the court said it was "sufficient to keep the Petitioner(s) in custody."
Comparing the cases to those of other accused who were given bail in the matter, the court said the Petitioners "did not satisfy the ingredients to claim bail on ground of parity with the other co-accused...as none of those co-accused...were caught in an overt act..."
