I’m heading to #LeteciaStauch’s preliminary hearing, where prosecutors must prove to the judge there’s enough evidence to take the case to trial.

She’s accused of killing her 11-year-old stepson, #GannonStauch, on Jan. 27, 2020. @KOAA

The preliminary hearing has been pushed back several times; it was originally scheduled for mid-March, before #Stauch waived her right to counsel and decided to represent herself. She then reversed that decision, and will now be represented by Josh Tolini.

While #Stauch was representing herself, the prosecution released their witness list for the preliminary hearing.

Out of the seven names listed, five are from the El Paso County Sheriff's Office, and one is from the FBI. Harley Hunt, Stauch's daughter, is also on the list. Image
The arrest affidavit claims #Stauch texted Hunt to buy carpet cleaner, trash bags, and baking soda. Investigators believe these products were used to clean #Gannon's murder scene. The affidavit states there is a receipt to confirm the purchase.

According to the arrest affidavit, investigators believe Gannon was murdered in his bedroom by #Stauch on Jan. 27, because of blood evidence they found.

Investigators said Stauch's "story dramatically changed multiple times" in the following days.

There is no information available in the affidavit about the discovery of #Gannon's remains in the panhandle of Florida on March 20, since #Stauch's arrest happened on March 2.

We may get some of those answers in the preliminary hearing today.

We will not be allowed to leave the courtroom during the proceedings. Family is now inside.

There are papers hanging on the pews reminding everyone to obey proper courtroom decorum. No video recordings, audible comments, or emotional displays are allowed.

It looks like #LeteciaStauch is appearing virtually. We can see her in a screen at the front of the courtroom, with long black hair, a face mask, and wearing an orange jumpsuit.

Before we start, the judge asks if #Stauch can hear him... she doesn't appear to hear him. No nod, doesn't raise her hand. Three tries so far.

Attorneys and witnesses are the only people allowed to remove their masks, and that's when they are speaking.

It looks like Will Cook has joined #LeteciaStauch's defense team, alongside Josh Tolini.

Typically, the defendant would be present in the courtroom. "While Ms. Stauch wishes to have her preliminary hearing, she does not wish to be present for it," says Tolini.

The judge reviews the motion, and understands #Stauch wishes to waive her presence.

She won't be able to watch this hearing. "I have confidence in my defense counsel," says Stauch.

It's a change of pace from when she said legal experts don't have much value in the case. @KOAA
Allen, the lead prosecutor, says this is not a COVID related absence on #Stauch's part, "this is her own voluntary choice."

Allen says the defendant's presence is required at every critical stage, and her absence has waived her right to a preliminary hearing. @KOAA
Allen would like to enter a not guilty plea, and get this case going to trial. He says #Stauch now has no right to this proof evident, presumption great hearing.

Tolini says this does not constitute a waiver of the evidentiary process. He does not understand how #Stauch's decision makes it more difficult for the prosecution.

"This is not a case where eyewitness identification is key," says Tolini.

Tolini argues the opposite of Allen: sometimes having a defendant present makes the process more difficult.

Judge Werner: "In this case, Stauch is saying she wants the hearing to go forward, but doesn't want to be present for it."

We will proceed with presentation of evidence.
"I've had those cases where a defendant doesn't show up. She did, virtually," said Judge Werner, who agrees this is a bit of uncharted territory.

Dave Young for the people steps up to the podium. The first witness called today is Jason Yoder, from Santa Rosa County Florida. He's a sergeant with the major crimes division for the Santa Rosa Sheriff's Office.

His name is not on the original witness list published. @KOAA
Sgt. Yoder was on duty when they got a call about the discovery of a body under a bridge inside of a suitcase in March 2020.

The suitcase had been emptied before their arrival. It was found by bridge inspectors, who called 911.

The body was found during a routine check of the bridge. The bridge is the Escambia River Bridge.

It's a two-way travel bridge, separated by the eastbound and westbound sides.

When Sgt. Yoder got there, he saw a suitcase opened, and a body wrapped in blankets. @KOAA
Sgt. Yoder said the body appeared to be that of a small boy.

You would be going eastbound to get to Pensacola, which is not in Sgt. Yoder's jurisdiction. The river is the county line.

The westbound and eastbound lanes are at the same level. There's a pull over lane too. @KOAA
The body was found on the side of the eastbound lanes, where an emergency pull out lane can be found, which is close in distance to where the suitcase was found.

If you were standing in the pull off lane, and looked down, you would be able to see the suitcase. @KOAA
Sgt. Yoder says they determined at the scene that it was a male body, because of the clothes worn.

They "guestimated" the age of the body was around 9 years old at the time.

The body was taken by the medical examiner for an autopsy.

Sgt. Yoder says a flyer was brought to his attention: #GannonStauch.

"There were some similarities between the picture and the actual body. Dental features, height, weight, approximate age," says Sgt. Yoder.

He's never seen a body from another state in his jurisdiction. @KOAA
Sgt. Yoder attended the autopsy. He says the body was severely decomposed, wrapped in blankets, which were soiled along with the clothing.

The body was in a fetal position. Dr. Susan Ignacio, a forensic pathologist, performed the autopsy.

Sgt. Yoder saw injuries to the body.
He says there was several injuries, including a fractured skull, gunshot wound, two stab wounds, and what appeared to be defensive wounds to his hands.

#Gannon's father's eyes close as Sgt. Yoder describes the injuries.

Sgt. Yoder learned it was the body of #GannonStauch through DNA analysis.

Dr. Ignacio noted all the injuries discussed. She noted one gunshot wound, one skull fracture, and eighteen sharp force wounds (including those on the arms and hands).

The gunshot wound was to #Gannon's lower left jaw area. There was a projectile recovered from his skull. That was sent to the El Paso County Sheriff's Office.

During an X-ray, two projectiles were found in a pillow.

Sgt. Yoder is looking at a copy of the flyer brought to his attention regarding #Gannon. Now, the courtroom is also looking at the flyer. Sgt. Yoder says Gannon's teeth were one of his most identifiable features.

Al Stauch has his head in his hand, and appears to be crying.
Now, pictures of the scene where #Gannon was found are being viewed by the court. You can see a black suitcase, and behind the suitcase is a body wrapped in blankets.

Family members are consoling each other during this evidence.

If you're traveling this bridge at night, you would not know there's water under it. Sgt. Yoder says it's heavily traveled during the day, but he wouldn't think it is at night.

The impression of where the suitcase fell is around 6-8 feet from where the suitcase is pictured. Bridge inspectors dragged it out from underneath the bridge.

We then see the impression, in a picture taken from the bridge.

Then, a picture of a pillow with sharks on it is shown, which was discovered in the suitcase where two projectiles were found.

Al Stauch has not looked up.

Then, a photo of a blue blanket is seen, one side with sharks on it, matching the pillow and stained with dirt.

Another blanket was found in the suitcase. Two blankets, a pillow, and #GannonStauch were all in the suitcase.

Now, Sgt. Yoder's cross-examination by Josh Tolini is happening. The lights come on, and Al Stauch looks up for the first time since the photos have been presented.

"Did she (forensic pathologist) make a determination whether or not sharp force injuries would have been fatal?"

"She had it as a contributing factor."

There was no exit wound for the gunshot wound. @KOAA
It looked like bullets had entered the pillow, according to Sgt. Yoder. There were no exits of the projectiles from the pillow.

As far as the gunshot wound, the coroner said it would have been fatal in itself. She was not able to say if it was pre-mortem or post-mortem.

The blunt force injury to the head, a cracked skull, could have been caused by the fall from the bridge, according to Sgt. Yoder.

There were no determinations made about the distance of firing regarding the gunshot wound.

Cross-examination is over. Dave Young steps back up to the podium for a redirect.

Dr. Ignacio indicated the cause of death was gunshot wound with blunt-force trauma to the head. Young says that means both would be pre-mortem.

Sgt. Yoder estimates the body was in the suitcase for around a month, based on the decomposition.

Sgt. Yoder says there was body fluid that leaked through the suitcase found as well.

He's now off the stand. @KOAA
The next witness called is Kevin Clark, who is employed with the @4thJudicialDA. At the time of #GannonStauch's investigation, he was employed with the Colorado Springs Police Department.

Feb. 21, 2020 - Clark was requested to support the investigation, which was @EPCSheriff's.
Telematics is a system installed in vehicles that does a variety of searches and functions, in addition with the ability to collect location data corresponding with dates and times.

That's what Clark was interested in during this investigation.

On the screen, we see a map from the morning of Jan. 28, 2020, showing #LeteciaStauch's VW Tiguan Telematics. That's the day after prosecutors allege Stauch killed #Gannon.

It shows the route that the Tiguan took to the airport that morning, where Letecia picked up Al Stauch.
The affidavit insinuates #GannonStauch was in the trunk of the Tiguan during this trip to the airport.

Security cameras captured the Tiguan leaving the Lorson Ranch home around 8:15 AM. It travels westbound, goes north on Powers, and arrives at the airport around 8:20 AM.
Stauch is seen on video entering the airport and going to the Avis rental car area. Around 7 AM, her phone searches began looking for "cheap rental cars Colorado Springs."

Stauch was given a white Kia Rio, and she and Al Stauch left the airport in the rental car. @KOAA
The VW would spend the day in the #ColoradoSprings Airport parking lot, until Stauch returned around 7 PM to drop off the Kia, and pick up the VW.

Stauch arrived in the Falcon area around 7:27 PM.

Stauch spends about 30 minutes in a parking lot at the corner of Woodmen and McLaughlin road. The area was searched, but nothing of evidentiary value was found.

Airplane mode takes a device off a cellular network. Once Stauch got to Falcon, the phone was put in airplane mode.
We're still looking at Tuesday, Jan. 28, 2020 - showing the vehicle traveling westbound on Woodmen after the roughly 30 minute pause in Falcon.

Only telematics are used for this portion, since the cell phone was on airplane mode.

8:18-8:34 PM: Stauch continued westbound on Woodmen, went north on I-25, and exited onto Colorado Highway 105 (Monument).

8:34-8:46 PM: Stauch travels eastbound on 105 for 11 minutes, then doubles back to go westbound. Out and back trip on 105.

Phone is still on airplane.
8:57-9:07 PM: Arrows are going all over the place. Stauch is "just driving around" a new housing development, eventually exiting the development between 9:04 and 9:05 PM.

Clark says she spent about 15 minutes driving around that area.

9:07-9:19 PM: VW merges onto I-25 off of 105, travels northbound, exits onto County Line Road, travels westbound until it meets with 105, and then travels northbound on 105. The most northern point is now in Douglas County (you'll remember searches done in that area).

9:19-9:29 PM: A red "X" is seen on the map now, alongside the arrows. Stauch's vehicle traveled this road, and doubled back from northbound to southbound.

The area is rural, and pretty dark at night. Plus, it was winter.

Cell phone still on airplane mode.
There was a 5-6 minute discrepancy between when #Stauch traveled northbound versus southbound on that road. We'll come back to that in a moment.

9:29-9:47 PM: Defendant leaves Palmer Lake area, travels east on County Line, then merges onto I-25 South, and exits on Briargate.
Stauch's phone has been off the network at this point for around two hours.

When she exits Briargate at 9:51 PM, the phone connects to wifi at the Hilton hotel, and then at Starbucks in the Promenade Shops.

The phone is still on airplane, but now it can communicate. @KOAA
For 55 minutes, Stauch is communicating primarily with her then 17-year-old daughter, Harley Hunt.

10:50-11:30 PM: VW goes down I-25, exits Garden of the Gods, turns east onto Austin Bluffs, travels back to Woodmen... ends at Massage Envy on Powers, where Harley worked. @KOAA
At that time, Clark says Stauch was searching Amber Alerts on the internet, and checking Ring doorbell video.

11:30 PM: Harley was not at work at this time. She was at home.

After midnight, Harley picks up #LeteciaStauch, and the VW stays in the parking lot. @KOAA
Now, we're on Friday, Jan. 31, 2020.

Harley had to work on Wednesday morning, and brought Stauch back to the VW. Shortly after, the @EPCSheriff seized the VW and Stauch's phone.

Harley's car and phone were seized not long after.

We were about to circle back to a GPS tracker used on Friday, when Stauch used a different vehicle rented by her aunt.

But, the first break of the day is here. We'll reconvene at 10:40.

Court is back in session - in the middle of Kevin Clark's testimony. Michael Allen picks up where he left off.

Jan. 31, 2020 - #LeteciaStauch appeared on a local news station doing an interview. The Nissan (rented by Stauch's aunt) was visible when Stauch was on camera. @KOAA
4:00-5:13 PM: Nissan returns to curve in Palmer Lake, almost in the exact location as where the VW was a few days before.

It would have been brighter out at this time, than on Jan. 28.

Now, looking at two maps, a side-by-side comparison of telematics from VW on Jan. 28... and on the other side, the GPS tracker data from the Nissan on Jan. 31.

The maps show the two cars went to essentially the same location, a few days apart.

The data led to an extensive search of the area, and they decided to focus their efforts right near the curve where the cars both went.

The search (Feb. 12-20) found an important piece of evidence: a board was found at the S curve on Perry Park Road.

Allen says it shows Stauch traveling from Colorado, to Florida, and then on to South Carolina.

According to Clark, Stauch's daughter Harley was with her on this trip.

It shows Stauch stopping in Pensacola, Florida. The two stop there just after midnight on Feb. 4, 2020.

Based on evidence from Stauch's phone, there was a hotel reservation made at around 11:46 PM on the night of Feb. 3.

The map (Feb. 4, 2020) shows the Candlewood Suites, where Stauch rented a room.

4:15 AM: Close to the bridge where #Gannon was recovered, #Stauch's location pinged. It's around 3.3 miles from where Gannon was found.

On the screen is a receipt from Candlewood Suites from the Feb. 4 stay. The guest information says #LeteciaStauch, and has her address from South Carolina.

She stayed for a matter of hours before going to Orlando, and then South Carolina. @KOAA
And with that, Allen is done. There will be no cross-examination of Clark. He's all done.

The next witness is Patrick Younkin, a sergeant from the El Paso County Sheriff's Office. @KOAA
Sgt. Younkin is a patrol division supervisor, who was on duty on Jan. 27, 2020. At around 10:09 PM, he responded to a reported runaway juvenile (#GannonStauch).

The actual call came in at 6:55 PM. Runaways are given a non-emergent priority on their call system.

Sgt. Younkin helped search the residence for a "hiding juvenile." He searched bedrooms, closets, an attached garage, etc.

Sgt. Younkin spoke with #LeteciaStauch twice. Once in the attached garage, and another time in the lower level of the home. His body-worn camera was on.
Now, the court will watch the body-worn camera video from Sgt. Younkin.

We first see the front door. It's dark out.

You can hear Letecia Stauch speaking as they go inside.

"Did he take his bike?"
"No," says Stauch.

You can see #Stauch in the video. Sgt. Younkin starts searching the home.

He opens closets, checks showers, and shines a flashlight in bedrooms and under beds. All the while, you can still hear Stauch faintly in the background.

Stauch: "He said he was going to his friends house... I don't know the exact time..."

Landen, #Gannon's mother, is watching intently.

Sgt. Younkin the shines the light in the garage, and #Letecia walks into the garage, saying her ID may be in the car.

He asks if she drove the car today. She initially says yes, then says no.

Sgt. Younkin opens the backseat. Stauch says #Gannon's never hidden in there before.
Sgt. Younkin then checks the trunk. It's very quiet in the garage.

The affidavit claims #Stauch put #Gannon in the trunk of the car.

He doesn't find anything.

Sgt. Younkin continues searching the home. Fast forward to the present moment: while he sits on the stand, he's paying close attention to the video.

We pause the video as Sgt. Younkin enters #GannonStauch's bedroom.

Sgt. Younkin shines a flashlight under the beds, then exits.

#LeteciaStauch comes down, saying she has a box cutter somewhere down there. She's laughing, saying she must have put it away.

#LeteciaStauch says she spoke to parents of some of #Gannon's friends who came over - and picks up Gannon's wallet.

"He forgets to like bring this or bring that," says Stauch, after she says she teaches fifth grade and knows some very "mature" kids.

"How long have you guys lived here?"
"Maybe like a year or something now."
"And you've talked to all of his friends?"
Stauch says she doesn't talk to the friends, and her husband has all their numbers. "I don't know the people like that."

#LeteciaStauch says Al Stauch has been talking to lots of people about where #Gannon could be.

Stauch says one of Gannon's game consoles is gone. She says "some lady" online messaged her with a picture of Gannon, holding a game console. She says the picture was in Lorson Ranch.
Stauch gives a description of Gannon, saying he's "very pale, with whitish color skin."

She says he was wearing a blue jacket, like a windbreaker, and blue jeans.

Stauch tells officers it would be best to call her husband. @KOAA
"As far as the medical, dental, he'll know all that stuff, because he takes them on base," says Letecia, referencing Al.

The video just ended, and in total was over 20 minutes long.

Sgt. Younkin says he looked under #Gannon's bed to see if there was a child hiding under there, but didn't see anything that stood out to him.

As Sgt. Younkin looks around the room, and didn't see anything like blood. The nature of his search was for a little boy. @KOAA
Sgt. Younkin said he had no indication that something violent had occurred. If he had thought so, they probably would have locked down the house and called investigative unit.

In the garage, it was dark. Sgt. Younkin saw a lot of wood, and wood-working equipment there.
It's time for Sgt. Younkin's cross-examination. Will Cook steps up, and first asks who was the reporting party.

"#LeteciaStauch," says Sgt. Younkin.

Sgt. Younkin did go back to the home a few days later to assist with a search warrant. @KOAA
"Did you find any type of suitcase in the Volkswagen?"
"I don't know if there was a suitcase in there specifically," answers Sgt. Younkin.

"Did the interior lights of the VW come on?"
"I don't recall if the interior lights came on, but I did utilize my flashlight."

The point of Cook's cross-examination of Sgt. Younkin: he saw nothing suspicious on January 27, 2020.

During Sgt. Younkin's re-direct, he says while executing the search warrant a few days later, circumstances had changed. They were now looking for trace evidence.

"When I was inside the garage, I found what appeared to be a red liquid substance," says Sgt. Younkin.

Sgt. Younkin says the substance was dry by that time. And with that, he's off the stand.

The next witness called is John Sarkisian, also of the El Paso County Sheriff's Office. @KOAA
Lt. Sarkisian was asked to run command for the search efforts in the #GannonStauch case.

The general date range for the search was roughly in late January to mid or late February. They used planes, drones, ATVs, horses, canines, pretty much any tools available to them. @KOAA
Lt. Sarkisian said the vehicle tracker showed #Stauch on Perry Park Road, and had stopped for an amount of time.

"Knowing that area, it's pretty heavily wooded up there," says Lt. Sarkisian. That was notable for detectives.

We're back to talking about the S curve on Perry Park. Map for reference.

Photos shown to the court depict a snowy day during the search, and a board found near the curve.

Lt. Sarkisian said a dog alerted on an area, and they checked that spot. While he was out, he started checking the barbed wire fence that ran along the road, since barbed wire catches a lot of things.

As he moved up into the trees, he noticed a flat board. @KOAA
He says the board obviously had not been picked up or examined at that point. Now, we're seeing a picture of what he found.

It's a board, near some scrub oak and pine trees, with part of the board under some snow.

A new picture on the screen shows a clear shot of the board, with "some type of stain on it."

"Just from my training experience, over the years, I believed it was blood on the board," said Lt. Sarkisian. He told the FBI.

The stain was tested, and came back as #Gannon's blood.
On to the cross-examination of Lt. Sarkisian. Tolini asks how many dogs were out there, and Lt. Sarkisian is not sure.

At that point, the search in that area had been going on for several days.

There were multiple footprints noted around the board. Lt. Sarkisian says he does not believe the footprints were documented, but that would have been up to the FBI.

Lt. Sarkisian estimates the board was around two feet long. @KOAA
Tolini points out the board was too small to carry a body.

"I understand that Gannon's blood was on that board, but other than that, is there anything that links it to the #Stauch residence?"
"Not that I am aware of," says Lt. Sarkisian.

Re-direct of Lt. Sarkisian only confirms it snowed several times during the search in that area.

And with that, it's lunch. We'll be back at 1:20. Allen says at the pace we're going at now, it's likely they will finish their evidence TODAY.

And we're back at 1:23 PM. Judge Gregory Werner is on the bench. Sgt. Rosario Hubble of the El Paso County Sheriff's Office is now on the stand.

In January 2020, he was assigned as the sergeant of the major crimes unit for the investigations division.

The major crimes unit investigates missing persons and child runaways. Sgt. Hubble says those are handled differently than a homicide case.

The #GannonStauch case eventually evolved into a homicide case. Sgt. Hubble had access to #LeteciaStauch's phone, where two photographs were found showing Gannon in his bed in what appears to be his bedroom.

Sounds like we're about to see the pictures.

The first picture shows #Gannon, wearing a green shirt, and sleeping on his side. His face is toward the window of his room, with light pouring into the bedroom. It looks like it was taken near the doorway.

The next picture appears to be taken from the foot of the bed. @KOAA
The bedding in the photographs shows shark sheets, and one of the blankets we saw in the suitcase found underneath the bridge in Florida.

At 8:17 AM on Jan. 27, the pictures show Gannon alive, and we can't see any injuries.

Now, another picture of Gannon sleeping is side-by-side with photos of bedding taken by the Santa Rosa Sheriff's Office. The pattern on the pillow case appears to match, and there's similarities between the bedding.

"It appears to be that we're looking at the same bedding."
Next, it's a side-by-side of #Gannon sleeping with a patterned blanket, next to the picture of a blanket found inside the suitcase in Florida.

"The pattern on that blanket is very consistent... with the photo taken off of Ms. Stauch's phone."

"The items received back from Florida are very consistent, yes," said Sgt. Hubble. He just reviewed photographs, and never viewed the physical items.

In the body-worn camera footage, it is not the same bedding in Gannon's room as in the pictures.

It appears the bedding was changed from the morning of Jan.27, to the evening.

On Feb. 3, during a search, Sgt. Hubble said they were very interested in trying to locate any blood in the house. They were concerned about foul play, and were looking for blood evidence.

They brought the Metro Crime Lab on scene - they're crime scene collection experts.

They use Bluestar for presumptive blood tests, which can be sprayed to show illumination, indicating either a presumptive positive hit for blood or an area that's been cleaned.

A new picture shows #Gannon's bedroom, without a bed in it. The carpet has been ripped up in the corner that was under his bed. Underneath it, there's a stain, which came back positive for Gannon's blood.

The bed was covering the stain, which leaked through the carpet, and all the way to the concrete underneath it.

"The stain saturated the carpet, and the pad, and went directly to the concrete," said Sgt. Hubble.

"Before this carpet was pulled, there was no visible blood."
That portion of carpet appeared matted and crusted, before they pulled it up. It was stiff to the touch.

Sgt. Hubble wanted the carpet pulled back to know how much blood had soaked through. It was apparent to him the carpet had been cleaned, but not the padding or the concrete.
The next photo is a close-up of a corner of #Gannon's mattress, in addition to an electrical outlet on the wall.

The edge of the mattress is stained, with a reddish-orange color, which was tested and came back positive for blood, and matched #Gannon's DNA profile. @KOAA
Sgt. Hubble said they noticed a pattern of presumptive blood throughout the house.

Starting in the garage, they got positive hits leading to the laundry room, where minor hits were found, leading into the hallway into the master bedroom and living room. (cont.)
They followed the hits down the stairs, until the hits led them to the storage room, and then to #Gannon's room.

"We were able to actually follow a trail," said Sgt. Hubble.

He believes the beginning of the trail was the stain under Gannon's bed. @KOAA
Another picture shows wooden steps, with a throw rug at the bottom of the stairs, which lead into the garage. The area was tested, and got some presumptive positive hits on the stairs and the carpet.

There was lots of woodwork in the garage, according to Sgt. Hubble. @KOAA
"There was a lot of wood that you could visibly see in the garage, yes."

The next picture is the same photo, but showing a Bluestar reaction on the throw rug at the bottom of the stairs. There are blue spots on the rug. It was tested: positive for blood and matching Gannon.
The next picture shows women's Nike sneakers. The sole area of the right shoe was swabbed, where you see a dark coloration. It came back positive for blood, and the DNA profile matched #Gannon.

"So the blood on the bottom of the right shoe belonged to Gannon?"
"It did."
Sgt. Hubble later learned the shoes were #LeteciaStauch's.

Sgt. Hubble says there was evidence of some type of cleaning that happened in the home as well.

Now, a picture shows a master bedroom on the main floor of the home. There's a made bed, with a TV on top of one of the dressers in the room.

A gun was recovered from this bedroom. It was found on the top of the dresser without a TV on it.

It was Al and Letecia's room.
A photo of the 9 mm gun is now shown to the court. You can see a picture of #Gannon next to the gun on the dresser, along with a stuffed animal on the other side.

The DNA profile on the gun matched #LeteciaStauch. Al's DNA was also found, but the major profile was Letecia's.
EPSO was sent three projectiles from the Santa Rosa Sheriff's Office. Sgt. Hubble says they believe the 9 mm gun was used to fire the rounds collected in Florida.

Particularly, the one recovered in #Gannon's head was consistent with the firearm.

Now, Sgt. Hubble's cross-examination. Will Cook walks up to the podium.

The defense says there was a mixture of DNA on the gun. "Presumably, you have three different individuals DNA on that gun."

It was two males and one female. @KOAA
"There was multiple profiles that were detected, yes," says Sgt. Hubble.

Now, Cook wants to talk more about Bluestar. "I know that if it fluoresces, we're going to test it," said Sgt. Hubble.

There was a technical problem with the camera of a crime scene investigator when trying to photograph some of the Bluestar tests.

It's the same camera that took the picture of the reaction in the garage near the stairs.

"He was having issues, and it was not working correctly."
You need to have low light conditions for a Bluestar reaction to be visible, according to Sgt. Hubble.

He knows the presumptive positive hits don't last very long.

The blood on the concrete under #Gannon's bed appears the way it does in the photograph; it was something you could visibly see. There was nothing done to enhance it.

Sgt. Hubble touched the carpet with an "ungloved hand," which concerned him. "That was a mistake."
Sgt. Hubble described the carpet as "crunchy" because he touched that portion of the carpet. He wanted to make sure investigators knew what had happened.

"So you contaminated the scene?"
"That was my concern, yes."

That's all from the defense, and there will be no re-direct from the prosecution.

The next witness is Special Agent Andrew Cohen of the FBI. @KOAA
The FBI really acted in a supporting role to the El Paso County Sheriff's Office, according to Agent Cohen.

Agent Cohen was the lead case agent on the #GannonStauch investigation for the FBI.

"In a case like this, would it be typical to look at closely associated people as potential suspects?"
"Absolutely," replies Agent Cohen, who said there was no evidence to suggest Al Stauch was involved in #GannonStauch's death. He was in Oklahoma at the time.

"It's quite a distance," between where the board was found off of Perry Park Road and the #Stauch's Lorson Ranch home.

Agent Cohen said there is also no evidence indicating Landen or Laina (Gannon's sister) were involved in #Gannon's death. Laina was 8 years old at the time.
"Letecia Stauch was the only adult responsible for the care of those children," said Agent Cohen, referencing the time frame when Al was in Oklahoma.

Harley Hunt was also living in the home at the time, and was 17 years old. She worked at Massage Envy off of Powers. @KOAA
Harley went to work around 8 AM on January 27 - and the two photos of #Gannon in bed were taken after Harley left. Laina was in school at the time.

During the time of those photographs, the only people home were Gannon and Letecia. @KOAA
Besides the fact that Harley was with her mother on the road trip from Colorado to South Carolina, Agent Cohen does not believe Harley was home when Gannon died.

"I do not have any evidence that she was involved in the murder of Gannon," said Agent Cohen, speaking about Harley.
There was a security system at the Stauch home, and there was never any evidence that an unknown person entered the home during the time #Gannon was allegedly killed in his bed.

"Based on your knowledge of the investigation, were there extensive efforts by the defendant to hide what she had done?"

Agent Cohen says yes.

For example, the body found in Florida, cleaning of #Gannon's bedroom, and the board found so far away. @KOAA
Now for Agent Cohen's cross-examination.

Tolini: There's a lot of talk about who would have been home when Gannon Stauch was killed.
But Agent Cohen cannot give any scientific evidence as to an exact time of death.

Agent Cohen cannot say if the blood found in #Gannon's bedroom was caused by a gun or blunt-force trauma.

Agent Cohen also never talked to the coroner who performed the autopsy.

Tolini says there are four unidentified DNA profiles found on the gun that killed #Gannon, but Agent Cohen said he doesn't have that information.

"Has anyone tried to find out who those four people are?"
"Not to my knowledge."

Tolini now says investigators were frustrated by Stauch "clearly" lying to them. She has a significant history of fabricating things that are easily shown to be false, according to Tolini.

Agent Cohen said frustrated is not the word he would use.

"In most cases involving the abduction and homicide of a child, the vast majority are by biological parents, right?" Tolini asks, based on an FBI report.

Agent Cohen confirms, and says it is less common for stepparents to be involved in such crimes.

Tolini says many people believed #LeteciaStauch to be a good stepmom.
"Certainly, no one could have predicted this," replied Agent Cohen.

Agent Cohen has not personally reviewed the autopsy report. With that, Tolini is finished.

Cause of death: gunshot wound and blunt-trauma to the head
Contributory conditions: sharp-force injuries
Manner of death: homicide

Agent Cohen was asked about the DNA on the gun. The major profile DNA match on that gun was #LeteciaStauch, and she was home at the time.

"Based on the evidence, can we pinpoint the day he was killed?"
"Yes we can," says Agent Cohen, even though he cannot give a specific time.
And that's the conclusion of the prosecution's evidence. There will be no more witnesses from the prosecution today.

Judge Werner will not issue a ruling today. They will set a date for that.

There's another matter that needs to be addressed by the judge, regarding #LeteciaStauch's escape case. She has also asked to waive her presence at the preliminary hearing for that case. @KOAA
The issue regarding the escape case will require #LeteciaStauch to appear via WebEx at 3:45.

Back in court. #LeteciaStauch is present virtually on WebEx. She confirms she wants to waive her presence at her preliminary hearing for her escape case as well.

The judge confirms Stauch is not on quarantine, and these decisions are not COVID related. @KOAA
The Judge is setting the decision on whether or not the #GannonStauch murder case will head to trial on Sep. 23, at 9 AM.

"I have pages of notes... the law requires I make certain findings based on the evidence presented."

"I'm sure you all want me to get it right. I do too."
The judge will have to think about a WebEx stream for the September 23 date, for family who has to travel for the proceedings.

He's not sure what he will do about that. The defense does not object to having a WebEx stream for family.

I want to send out one clarification: #LeteciaStauch waived her right to her preliminary hearing ENTIRELY for her escape case. The judge will rule on both matters on September 23.
