This is a new thread for the afternoon of Monday 13th September, Day 35 of the Dr Webberley Tribunal hearing. The Panel were due to resume at 2.00 pm but it looks as though they are delayed in private session, time now 2.25 pm, more news as it happens .....
3.05 pm we are back. SJ is in the middle of addressing the panel about, I think, the burden of proof in relation to this case. references to Husband (?) and Sonny(?) will check these case references later. When considering the submissions consider them one at a time. Records:
GMC has produced the records. Question is are there any other records? Is anything missing ? If we can show some things are missing - does that mean things that are relevant are missing/ no, we can't make that leap. These issues were tentatively addressed earlier. Sufficiency is
a separate issue. Documents put to someone in cross examination does not make it evidence. Rule 7 and the existence of emails does not assist the Defendant at this stage. Dr Webberley has to refer to these records to bring them in as evidence. 23.09.17 in C2 p470 for example -
Twitter has jumped two messages - sorry. SJ replying to IS's submissions continues. He is responding to IS's claim that the GMC documents are incomplete. SJ says only HW can explain/amplify the documents - an order made and prescription signed, all you need to be satisfied
that prescribing was done. Nothing from HW to positively indicate communication/discussion that enquiries were made at this stage. Charge 7 stands. Matter for HW to give evidence. Charge 8 re Patient E evidence of Dr Harker D 18 failure to assess Patient E - did not refer or give
follow up advice. GMC submit that based on Dr Harker and the references I have made you are entitled to proceed on these Charges. P asks about the admin dashboard - is this the right place to get the documents from? SJ says not clear whether this supports IS or not. Some records
lost, some destroyed. GMC say these records on their face support the charges. Whether there might be more is outside what the GMC knows. HW can tell us more. GMC says nothing has been conceded or identified by Mr Stubbs that there is more missing than is visible, You have all
the documents that are relevant for the charges. The mere statement that there are missing records does not take these charges out. You cannot speculate about what else there might be put there. Panel thanks SJ. On to Work Details Form and Duty of Disclosure WDF SJ reads it out
Very thorough and searching questions on the form. GPs also note - provide details of ..... All HW has said is that she works for her own online business. Why are these questions being asked? Because the GMC wants to ask all the right people all the relevant questions.
GMC 's case is that HW did not answer completely or truthfully. HW chose not to disclose the whole picture. Has there been a deliberate non-disclosure? Her reasons have not yet been given - matter for her in her evidence. Requirement to report? Primary care organisations means
any organisation including outside Wales. Charges 21b et seq - Dr Taylor was Deputy Responsible Officer - he was never notified that there was an ongoing GMC investigation. There was a duty to notify under regulation 9. D2 661 the June letter refers to GMC's investigation having
started in March. Letter from HW's solicitors - does not refer to a current investigation but to her recent suspension and equivocal reference to possibility of a wider investigation. p665 duty to notify without delay arose as soon as HW was notified as soon as the investigation
That correspondence is not an answer.

SJ has been researching something and technical link now re-established. SJ still needs to investigate something. IS no comment. Adjourned now until 9.30 a.m. (Bit of a mystery about what exactly SJ is trying to establish - we will find out tomorrow no doubt.) Good bye for now.

A reminder that we don't have access to the legal bundle of the case against Dr Webberley (HW) who is represented by Ian Stern QC (IS). Counsel for the GMC is Simon Jackson QC (SJ) and Dr K is Dr Kieran. P stands for Panel member (of which there are 3)
Dr K (AK) is Clinical Psychologist at the NHS KOI Children & YP GIDS clinic in Northern Ireland
