Judge Emmet Sullivan calls videos the government is presenting “very disturbing” and says it’s “outrageous” that McAbee wore a sheriff’s patch.

Prosecutor argued videos show Thea “joined in that assault” on officers and was working against officers protecting the Capitol.

Judge Sullivan is agreeing with the government’s interpretations of the videos. “It appears clearly to this court that” the defendant is pulling an officer into the mob.

Defense is arguing that McAbee was attempting to assist an officer his fellow Trump fanatics were assaulting.

Also arguing that he only pushed an officer after he was pushed.

Judge Sullivan to defense: “Am I just to forget about what I see with my own eyes?”

Sullivan says he can draw appropriate inferences from what is clearly depicted on the screen.

Defense suggests home confinement could be an alternative to being locked up in D.C. jail. (McAbe was himself a corrections officer.)

DOJ: “This is a defendant that has taken oaths before… His job was on the line when he went to the Capitol on January 6.” Says he went against medical advice and the advice of his wife.

“This is someone who uses his badge and authority when it works for him.”

DOJ: “He saw no conflict between his oath to uphold the law and abide by the law and what he did on Jan. 6.”
