Plaintiff's counsel notes that the case has been pending nearly five years now.
Trump's new lawyer Alina Habba is now up. She claims she is going to file a counterclaim under NY's new anti-SLAPP law.

Habba: "Most importantly, Ms. Zervos is claiming emotional damages and financial damages."

She claims they do not yet have medical records during discovery.

"You can't depose people when you don't have medical records" in an emotional damages claim, she says.
Plaintiff's counsel says they are looking for dates for seeking Trump's deposition.

She also denies claim that Zervos has withheld medical records.

"We have produced more than 500 pages of medical records," she says.
The judge's law clerk says he will turn to the question of depositions later.
The parties seek to end all fact discovery — including depositions — by Dec. 23.

It was previously stayed, but the judge's law clerk said scheduling should be speedy because Trump was previously president.

"Now, he's a private citizen," the clerk noted.

And the prosecution's investigation apparently considerably advanced since the guilty plea and cooperation of their alleged co-conspirator Josiah Colt.
The new charges detail their chilling alleged communication before Jan. 6, a day Sandlin supposedly believed Trump would decide to "cross the Rubicon."

A frequent pro-Trump fantasy around the time, the phrase refers to Julius Caesar action that led to him becoming a dictator.

A hearing is about to begin for the ex-police officer charged in the breach of the U.S. Capitol.

A judge kept him jailed pending trial after feds said they found guns and "pipe bomb" components in his home.

AUSA Elizabeth Ann Aloi said investigation is still going on as to the allegations at the heart of that detention motion.

She said she doesn't expect a superseding indictment related to that in this case.

Obstructing an official proceeding will be the top charge.
The prosecutor notes Robertson isn't in jail for the charges against him, but his failure to follow court orders.

He did so despite acknowledging the whole 'fool for a client' adage.

The judge presses does he understand he currently faces significant jeopardy from the charges.
