Status hearing up now for Tim Hale-Cusanelli. He’s been in jail since January 15, charged with no violent crime related to January 6. Trial set for November 9, DOJ asking for another continuance. McFadden said he was not inclined to delay trial. We’ll see what he says today
McFadden said last week he was concerned about unfair treatment btw J6 and “social unrest” protesters. Hale is in DC jail. McFadden explaining District Court COVID rules limiting in-person trials. This will be his excuse to delay trial. “This will be first January 6 case.”
“No room in courthouse for this trial. Logistical nightmare. I don’t see any case as recent as this one.” 2019, 2020 cases starting first.

Status hearing for George Tanios and Julian Khater, the 2 men arrested in March for "spraying" Brian Sicknick. My column explaining the case here:

Tanios released on appeal in August. Khater remains in DC jail. Judge Hogan, presiding today, rejected a $15 million bond offer by Khater's family.

Neither man has a criminal record. Video evidence sketchy as hell in the case.

DOJ: Once again confirming discovery issues at DC jail. This is an ongoing problem--jail preventing detainees from looking at evidence.

Khater atty: Prison situation is "dire" beyond discovery. Detainees in solitary, mocked by guards, inadequate food, sleeping, etc.

Political prisoner update: Tim Hale-Cusanelli has been behind bars since he turned himself in on January 15. (In DC Gitmo since early February). He is accused of no violent crime. Hearing this week to delay his trial, set for November 9. A brief history from recent filing:
Judge McFadden, the one who just gave lip service about unequal treatment of J6 vs other political activists, has delayed Hale's speedy trial rights at least 10 times. Now at 240 days past arrest. (This was filed 9/17/)

This is why Judge McFadden's comments about equal justice are mostly lip service. Here's what he told a January 6 protester charged with nonviolent offenses: "You were acting like those looters and rioters who attacked our city last year. You participated in a shameful event...
a national embarrassment that, like last year's riots, made us feel less safe and less confident that our country could be governed by democratic values and not mob rule." Any judge who compares January 6 to the rioting in DC last year should be thrown off the bench.
LOL clown show: "Prosecutors have previously argued that the comparison is unfair and that the insurrection was worse than riots in Portland, Oregon, and other cities last year. They said the January 6 attack was much larger and put hundreds of lawmakers in imminent danger."
