At 9:30 am EST, both men will be back in court for a joint hearing.
This is a big day for them and is likely to have serious repercussions for what their coming years look like.
The prosecution is seeking terrorism sentencing enhancements in the case.
If the judge imposes the enhancements, it is expected to drastically increase the amount of time the two men spend behind bars.
Mathews and Lemley, two members of the neo-Nazi paramilitary group the Base, were arrested by the FBI and ATF in January 2020. LE alleges the men were plotting a terror attack in Richmond, Va.
They pleaded guilty to various felonies in June. They will be sentenced Thursday.
One noteworthy element of the case is the vast discrepancy between the lengths of sentences the prosecution and defence are seeking.
The prosecution has requested Mathews and Lemley be sentenced to 25 years. The defence teams are seeking 33 months.
I can’t use my phone in the court so I will provide an update — with a story to follow — after the hearing.
Court recessed for 15 minutes. The morning session was taken up entirely by the prosecution’s arguments in favour of terrorism sentencing enhancements.
They also laid out a display of evidence — guns, ammunition, tactical gear, radio communications, propaganda materials, gas mask, etc — which an FBI agent who investigated the case walked through.

Court broke for recess. Lemley’s defence attorneys are finished presenting their arguments to the court.
Up next is Joseph Balter, Mathews defence attorney. Unclear if the judge will deliver his verdict on the sentencing enhancements today or not.
The hearing has ended. The judge has sided with the prosecution on all points of contention: the terrorism sentencing enhancements will be applied to Mathews + Lemley.
The judge says he remains open to arguments from defence attorneys at the upcoming hearing on what their ultimate sentence should be.

The success of this election for the PPC should not be judged on seats won, but on the percentage of the popular vote received.
When you look at the popular vote in 2019 compared to 2021, you’ll see all the parties (aside from the Greens and PPC) remained relatively flat or saw slight increases/decreases. There wasn’t a lot of movement.

- Zane Tessler has the authority to lay criminal charges at his own discretion, despite not being a Crown. That's a power he has but has chosen not to use in this case.
- As my colleague @thatkatiemay and I noted in a recent story: We found 18 cases where the IIU forwarded an investigative file to the Crown for review. In all 18 cases, the Crown instructed the IIU not to press charges.
Breaking: U.S. federal grand juries in Delaware and Maryland have indicted Patrik Mathews on two felony firearms charges and an obstruction of justice charge for destroying evidence. #wfp
Mathews was scheduled to return to federal court in Greenbelt, Md. Thursday for a preliminary hearing.
At the hearing (public) the judge would have ruled whether the state had enough evidence to move forward with a trial.
Instead, the state conveyed grand juries (private).
The grand juries heard the evidence against Mathews and his co-accused and pressed forward on charges. The cases can now move to trial, barring a plea deal or the charges being dropped.

Today U.S. law enforcement arrested three members of The Base from Georgia who were planning to kill a married couple that engaged in anti-fascist activism following an investigation by an undercover FBI agent.
I’ve read the affidavit used to secure the arrests warrants and it includes shocking new details about the activities of Patrik Mathews while he was on the run from law enforcement in the U.S.
This was an absolutely horrific weekend for crime in Winnipeg. By far the worst I’ve seen in my career. Police said you have to go back about five years to find a spate of violence like this.
Here’s a rundown of what happened and what we know (it's going to be long):
In total, three people are dead (including a 14 year old) and four are injured (including a child under the age of two) in three separate incidents.
Winnipeg’s homicide total for 2019 now sits at 36.
The carnage began with two stabbings at a Halloween party on the 100 block of Kinver Avenue Saturday night.
I’m told a teenage girl threw a party at her father’s home while he was away and things got out of hand.
