STANDBY: Hearing in high-level Jan 6 case of Thomas Sibick begins in 15 mins. Sibick will argue for release from jail. He says he's volunteered for "solitary" amid friction w/ other J6 inmates
He's accused of assaulting officer, stealing badge & radio. He pleaded NOT GUILTY
Among many arguments, Sibick's defense says a repeat of Jan 6 is unlikely. He argues recent Trump rallies have not led to violence, even though the "Former President has continued to advance his conspiracy theories and factually-unproven.. claims"
Sibick's defense adds, "The one rally that was scheduled for Saturday, September 18, 2021, in Washington, D.C., and where violence was anticipated, turned into an embarrassment for the organizers, as attendance was extremely low."
About allegations he stole officer badge, radio:
Sibick's motion, ahead of hearing, argues, "Mr. Sibick never posed with the badge or the radio belonging to Officer Fanone – something one would think he would do if he had intentionally grabbed those items as “trophies.”
Sibick has six prior misdemeanor cases, including drug possession, DUI and reckless endangerment
We'll see if those come up at today's hearing
Defense lawyer argues Sibick's "mindset" has changed since Jan 6. Then attorney says Jan 6 inmates sing the national anthem in jail each day... lawyer adds, "It was almost cult like"
Sibick's dad is speaking now. (Judge has concerns that Sibick's dad came to DC during Sept 18 rally and has made public criticism of jailing of Jan 6 defendants)
Judge says I don't want to send him from one "strident" environment to another... if he's released to parents
Judge says she won't order "no Fox News"... but she doesn't want cable news TV on in-the-house.. she wants a "calm environment" if Sibick is released to parents
Defense argues Sibick went to the "hole" in the jail at his own request to get away from the "toxic environment" and the other Jan 6 defendants in pretrial detention
Judge says Sibick has good upbringing.. but says "that cuts in both directions"... "he knew better" on Jan 6
Judge says, after feds' review of thousands of hours of videos and social media, Sibick's case does involve threats or "promises to return" that have been components of other cases that necessitated pretrial detention
!! Judge Amy Berman Jackson expresses concern about the "toxic environment" in the DC jail for Sibick. Raises "serious serious questions about (Jan 6 defendants) being housed together"
Judge says Sibick has earned the "benefit of the doubt"
Sibick will be released to parents' home 24/7
