We're back from lunch in Wisconsin v. Kyle Rittenhouse. We're back to a discussion about Anthony Huber and his "peacefulness" characteristic.
The state says it will bring up a specific instance in Huber's past where he displayed "peacefulness." Kraus says this leads to the state's point that Huber was acting to "protect" others on the night of August 25, 2020.
Judge Schroeder is now reading the State of Wisconsin text to determine what is/is not acceptable for the prosecution to include evidence that the "victim was a characteristically peaceful person."
Judge Schroeder: It seems to suggest that the prosecution can offer evidence in a homicide case to rebut evidence that the defendant was the first aggressor.
Judge Schroeder has now brought out a magnifying glass to look at the book he was reading from. This after the prosecution and defense both agree the text reads "victim."
Judge Schroeder then throws the book literally in the garbage. Defendant Kyle Rittenhouse, and others in the courtroom, laugh.
Chirafisi: It's character traits for peacefulness, which is what they're getting into.
Chirafisi is reading from a criminal complaint involving Anthony Huber, in which he held a knife to his brother.

Chirafisi: (Quoting the criminal complaint) Mr. Huber told his brother that if he didn't clean a room in their house, that he was going to 'gut him like a pig.'
Chirafisi brings up another case, in which he kicked his sister, "in the right hip causing her pain, causing her to fall into a nearby dog crate."

Chirafisi: I would not normally admit those [cases], but they are saying this is a peaceful man.
Kraus says he plans to withdraw that question that would speak to Huber's characteristic of "peacefulness."
Susan Hughes, the great aunt of Anthony Huber, is back on the stand. She says she found out he died at about 5:30 a.m. on August 26, 2020.
Kraus finishes his questioning and hands the witness over to the defense. Chirafisi says he has no questions.
The state calls Kariann Swart, the fiancée of Joseph Rosenbaum.
Swart testifies that when she first started dating Rosenbaum, the pair were homeless. She says he is from Waco, Texas. She testifies she is from Illinois.
In the days prior to the shooting, Swart testifies that Rosenbaum was, "at a hospital in Milwaukee."
Swart testifies that she saw the plastic bag Rosenbaum was carrying the night of August 25, 2020. This bag has been referenced several times so far. Swart testifies inside the bag there was paperwork, a small water bottle and travel size deodorant.
Swart testifies that Rosenbaum was unable to refill a prescription on August 25, 2020, because a nearby Walgreens was "boarded up" due to the unrest. She does say that he took his medication that day, though.
Swart testifies that she and Rosenbaum lived together in a tent for a time, and were together, "all the time." After some back and forth between the prosecution and state, Swart confirms Rosenbaum never introduced her to Joshua Ziminski.
Assistant DA James Kraus finishes questioning Swart. Chirafisi asks to approach the bench for clarification on questioning. Judge Schroeder then asks the jury to step out.
Both sides now discussing the specifics of Rosenbaum's medical history, including his recent hospital stay and medication list. This is to determine what questions the defense can ask witness Swart in cross-examination.
Judge Schroeder calls for the jury to re-enter. Chirafisi begins his cross-examination of Swart. She testifies that Rosenbaum was taking medication for bipolar disorder and depression.
Swart: I was concerned that because the entire city was up in flames, that something would happen to him, anywhere. But specifically it seemed like it was downtown. So because he was coming from Milwaukee, and didn't know all that info from Kenosha, I wanted to make sure he knew.
The state has a quick re-direct, and the defense provides no further questions.
The state calls Sahil Khindri, the owner of Car Planet dealership in Milwaukee. He worked at Car Source in Kenosha until 2015.
Khindri's father is the owner of the Car Source dealership in Kenosha.

Khindri: A lot of cars were burned. A lot of glass broken. Police had a caution tape around it.
Binger: Which morning was it that you came down [to Kenosha]?
Khindri: Monday morning.
B: So this was after Sunday night, into Monday morning?
K: Yes.
B: What, if anything, did you do after that?
K: Cried.
Khindri testifies that did not ask anyone to protect his car dealership properties in August 2020. He says he has never spoken with Kyle Rittenhouse, in-person or via phone.
Assistant DA Binger finishes up and defense attorney Corey Chirafisi begins cross-examination.

Chirafisi: These men are on your [family] property?
Khindri: Yes.
C: You don't ask them to leave, correct ?
K: Especially when they have guns ...
C: You didn't think they were there to harm you, did you?
K: No.
Khindri testifies that "the person with the white hat with the cross" had previously worked for his brother at a dealership.
(To Chirafisi's questions about whether anyone entered the car dealerships)
Khindri: I think the questions you have are more for my brother. Because I don't even work there.
Chriafisi finishes his cross-examination. Assistant DA Binger is back for re-direct.
Binger asks Khindri to read this text message to himself.
Khindri clarifies this text was sent to his brother, who goes by the name Sam.
Binger: Why are you in the picture?
Khindri: I saw the guy, right to the right of me, dressing up. And I was so impressed. And he mentioned he's from an ex-Army. And I'd never seen that, I normally see those things on TV. So I'm the one who requested, 'Can I take a picture?'
The state calls Anmol Khindri to the stand. He works for Car Source, his father's business. He is the brother to the previous witness.

We're back! Judge Bruce Schroeder calls for the jury to re-enter in the case of Wisconsin v. Kyle Rittenhouse.
Also of (small) note: the past two days, court has had to break for lunch early, because a food delivery came earlier than expected. Today, Judge Schroeder hopes to avoid that by ordering Subway. We'll see.

Judge Schroeder: One of the jurors is inquiring about a pregnancy ... my inclination, unless there's an objection, is to excuse her.
The juror is excused upon her request.
Pressing update: Judge Schroeder has mentioned concern for missing his haircut appointment several times this week. He just confirmed he was able to get his hair cut!

Judge Bruce Schroeder: We're back.
And so we begin Day Three of Wisconsin v. Kyle Rittenhouse.
We're beginning with the discussion about Juror 7. Judge Schroeder specifies that he travels "differently, because he uses that scooter." Juror 7 uses a motorized scooter to get around. He rides it in and out of the courtroom.
Judge says Juror 7 told a deputy a joke as he was leaving. It involved the shooting of Jacob Blake.
