Status hearing up now for Robert Morss. I spoke with him yesterday about his humiliating strip search he endured simply for meeting with his lawyer.

Presiding judge is Trevor McFadden, who has denied bond for a number of J6 defendants. (Trump appointee, another mistake.) On Wednesday, Judge Lamberth released Chris Worrell, a cancer patient, based on cruel treatment in DC Gulag and concerns over abuse by prison guards.
LOL McFadden says Morss' motion isn't an "emergency." Asks DOJ is they plan to respond.

McFadden is aware of recent findings by US Marshalls about egregious conditions at DC jail.

McFadden doesn't want to tell Marshall's where to move prisoners. Says plenty of DC inmates...
would rather be in the January 6 pod. Trust me, McFadden is such a lightweight that he probably hasn't read any reports or been briefed by Marshall's officials as Lamberth was.

Morss new attorney not yet in the courtroom.
Attorney arrives--John Kiyonaga.

DOJ explaining case against Morss' co-defendant, Geoffrey Sills. Both are behind bars, no trial date set.

Both accused of violence against police in lower west terrace where cops attacked protesters for hours. Location of Rosanne Boyland death
DOJ arguing why the two should be tried together. DOJ comments that Morss yelled "this is our house." OK.

Kiyonaga: We don't know how the events unfolded or exactly what happened in the tunnel. Capitol police not ready, did not mount a professional response.
Sills and Morss are not charged with conspiracy.

Kiyonaga wants to represent both men. DOJ, McFadden claim it's a conflict. "Nowhere nearly fully informed of the facts of that day."

"A lot of DC area attorneys will not represent these people." Truth. McFadden knows this too
Kiyonaga: Mr. Morss is a ranger and I am too. DOJ is going to argue he used his military training to "attack" the Capitol. DOJ has made those claims often.

No compelling case to keep Kiyonaga off Morss case.

Mentions still waiting for discovery. DOJ continues to delay discovery
McFadden asks whether DOJ will sever cases. She says maybe but not detained defendants, which both are.

Former court-appointed attys tell McFadden that Morss is college educated and a teacher. He's well aware what "conflict" means. DOJ has "random and capricious" way of charging
Atty says her office has several J6 defendants.

DOJ wants accused in multi-defendant cases to get different attorneys.

McFadden, 43, is a former assistant U.S. atty in DC. Same office prosecuting. Explains a lot.
McFadden continues questioning both men about their understanding about potential conflict of interest. Why is this? They have decided they want the same attorney. McFadden warns their trials might be delayed and in jail longer. What a waste of time.
Every time I listen to McFadden, I curse the Federalist Society. How could they recommend this lightweight to the bench?

McFadden, of course, said he was inclined to go with DOJ rec but agrees with Kiyonaga. Gives DOJ chance to respond. Finally decides they can share attorney
McFadden tells Kiyonaga his motion for emergency release isn't an emergency. Asks for immediate move to Alexandria jail. (Where Worrell is.)

Worried about retaliation against him. "Outrageous assault" against Morss yesterday. Cites Lamberth and Marshall's report as reasons why
Morss should be transferred immediately.

Kiyonaga does not want to go into graphic details of assault on Morss yesterday--they are of a sexual nature. I know what happened but will not share.
After a private discussion with Kiyonaga, McFadden will order Morss transferred to Northern Neck jail. Defends strip searches after interacting with someone on the outside including defense lawyers.

HOLY SH*T IS THIS GUY FOR REAL?

Won't say anything bad about DC jail. So sweet.
There is no way any judge could hear what happened to Morss and defend strip searches. Alas, Trevor McFadden just did. Further, he has no complaints about DC Gulag. Not a just a lightweight, a ghoul.

Worrell hearing about to start. Worrell and his lawyer discussing how their pre-hearing call was repeatedly disconnected.
Lamberth says he had a meeting with prosecutors and they confirmed there was no evidence before Lambeth’s order that surgeon did NOT recommend surgery for Worrell’s broken hand. Seems to suggest someone tried to coerce surgeon into changing his recommendation
Lamberth accusing DC DOC of withholding medical records from both US Marshall’s office and prosecutors. “They repeatedly did not give me. Now they want to weasel out and say they gave me everything.”
