Please don’t comment about the criminal justice system if you know nothing about it. I practiced criminal law for many years, and this is something judges say all the time. When a defendant negotiates a plea, he often gets a better sentence than he’d get from a judge after trial.

What this judge is saying, and again this is something I myself have heard as a criminal defense attorney many times, is, “You’re lucky that you and the prosecutor were able to reach an agreement, because if this were in my hands after a trial, I wouldn’t be as lenient with you.”
Our criminal justice system literally wouldn’t work if judges didn’t give defendants a big discount on their sentences for agreeing to a plea rather than forcing the system to undergo a costly trial. It’s *astounding* that @ggreenwald retweeted this embarrassingly ignorant tweet.
By retweeting this tweet, Glenn Greenwald has told an audience of millions that there’s a conspiracy against Trump supporters within the federal judiciary, when in fact what happened to Chansley happens every day across America.

Greenwald and Matt Taibbi daily confirm that they’re no longer journalists but instruments of the lucrative outrage/sense of victimhood nursed by Trump supporters. They have a *business model*—not principles. They’re an embarrassment to the profession to which they once belonged.
If someone wants to argue on principle that 97% of criminal cases shouldn’t plead out, and that the “trial penalty” should be erased, that’s fine. But in the *same goddamn breath* you better be advocating for a *tenfold increase* in funding for state and federal public defenders.
I agree we have too many criminal statutes, we should have more alternative resolutions for non-violent criminal incidents, we need more public defenders, and even 15% of cases going to trial would collapse our justice system overnight. But do *not* bring January 6 into all that.
