It is the 14th day of the #RittenhouseTrial … and the third day for jury deliberations
The front steps of the courthouse are empty for now.
Per @mtarm with the AP, a court official said the jurors have begun deliberations for the day.
They were behind closed doors for nearly 9 hours Monday (with a lunch break) and nearly 8 hours yesterday. #RittenhouseTrial
Yesterday -- jurors asked to see several videos in evidence, including drone video that has now become part of two motions for a mistrial.
The #Rittenhouse defense said it didn't know it had a lesser quality version until last Friday.
Prosecutors yesterday said when they received the video during the trial, it was via AirDrop -- a way to share files on Apple devices.
They said it was then shared from Det. Howard of the Kenosha PD to all parties via email, which compressed the file.
Corey Chirafisi, one of #KyleRittenhouse's defense attorneys, asked for a mistrial yesterday in court without prejudice because of this.
He said if they would have known there was a higher quality version than what they had, it would have changed how they presented their case
However, prosecutors said the jury only saw the one version of the drone video that was entered into evidence - which was the highest quality.
They said the defense never objected, and no one ever knew the defnse had a compressed version until last Friday.
That happened while the attorneys and Judge Schroeder were working out jury instructions and what lesser included charges would be given for consideration.
Schroeder wanted to see the video, so Wisco hooked the defense laptop up and while watching Kraus noted it wasn't as clear
That's what led to Schroeder saying "Show me the best picture"
So the prosecution had their IT person come with their laptop.
That motion, and a motion for a mistrial with prejudice (asked for in court last week and then filed with the court Monday) still loom over this case as we await a jury verdict.
If the jury reaches a not guilty verdict across the board -- these motions are moot.
However, if the jury reaches a guilty verdict on any of the charges #KyleRittenhouse faces, Judge Schroeder will have to rule one way or the other on those motions.
If the motion is granted WITH prejudice, the state cannot retry the case.
That is where we are right now.
The jury is entering it's 17th (ish) hour of deliberations.

I'm in the courtroom today. Judge Schroeder has more unrelated cases -- and it appears jurors may have gone right into deliberation as they have the last few days.

Yesterday, we didn't hear from jurors at all until the end of the day when the judge asked if anyone had questions when they were being dismissed.
One of the women on the jury asked if she could take a copy of jury instructions home, which Schroeder allowed.
Today, the jury will get its instructions, hear closing arguments, and then the 12 who will decide Kyle Rittenhouse's fate will be selected and could begin deliberations
Judge Bruce Schroeder is telling the defense he's worried reading the self defense instruction for each count it applies to could essentially bore the jury, because they will be talked at a lot today with instructions and closing arguments.
