Now, back to those applications submitted after the deadline.
The 3 types break down as:
1⃣ 52% late applications - missed the deadline
2⃣ 27% pre-settled status holders who must apply for settled status
3⃣ 21% joining family member applications - including new-born babies
1⃣ 'Late' applications
As we and many others pointed out, no scheme anywhere ever reached 100% of its target audience - and there's many reasons why people failed to apply on time.
We don't know what data the Home Office are recording on timing of issuing certificates of application.
Months-long delays between pressing submit and receiving that all-important certificate are happening not just for paper applications, but also for online ones using the app.
2⃣ Pre-settled 'upgrade' applications
People who currently have pre-settled status must make a new application for settled status before their pre-settled expires.
There were 45,700 of these Jul-Sept, with 16,200 still waiting for a decision. ft.com/content/5fecab…
A rough calculation shows that around 45,000 of these 'upgrades' need to be made every single month until the end of 2025 if all pre-settled holders are to secure their rights.
This is why we do not believe that the backlog can be cleared by spring 2022.
Spring 2023 more likely
3⃣ Joining family members
The Withdrawal Agreement provides that certain family members of EU citzs (in the UK before Dec 2020) can make an application to join them in the UK.
Not only are 99% of post-July JFM applicants still waiting, but of the few who had a decision only two-thirds got status.
We are aware of at least one case where the person was wrongly refused, DESPITE a recent (very overdue) fix to the immigration rules. ima-citizensrights.org.uk/news/home-offi…
These numbers represent thousands of split families.
Many tell us the lack of transparency and progress info adds huge extra anxiety.
A cross-party amendment has been tabled by @Meg_HillierMP to the Nationality and Borders bill, asking for physical proof of status for EU citizens.

Apart from correcting historical anomalies in citizenship legislation, the rest of the bill is mainly about the overhaul of the UK asylum system, which has been widely criticised.

On July 1, EU citizens who haven’t applied for status will lose their rights. No one should become unlawful on 1 July. This goes against the promise made in 2016. Innocent people will have the rug pulled from under their feet.
