They are not all 'late' applications - which is why the scheme will be very busy for years to come.

We'll analyse the 3 types of post-deadline applications, but first let's see how those submitted BEFORE the deadline are doing.

There were 606,000 outstanding applications on 1 July.

Of those, 274,000 - or 45% - are STILL waiting for a decision at the end of September. Image
We have reports of people waiting for months and months.

Time during which lives can be ruined - jobs lost, welfare denied. Let's not forget the context of COVID.

Now, back to those applications submitted after the deadline.

The 3 types break down as:
1⃣ 52% late applications - missed the deadline
2⃣ 27% pre-settled status holders who must apply for settled status
3⃣ 21% joining family member applications - including new-born babies Image
1⃣ 'Late' applications

As we and many others pointed out, no scheme anywhere ever reached 100% of its target audience - and there's many reasons why people failed to apply on time.

There were 89,900 late applications Jul-Sep and 73,500 of them - 82% - are still waiting for a decision.

We hear many are even still waiting for a Certificate of Application (which should be issued immediately!)

The certificates are absolutely essential.

No right to work/rent/healthcare/welfare.

The Govt announced on 6 August that late applicants would have their rights protected while waiting 🙂

We don't know what data the Home Office are recording on timing of issuing certificates of application.

Months-long delays between pressing submit and receiving that all-important certificate are happening not just for paper applications, but also for online ones using the app.
2⃣ Pre-settled 'upgrade' applications

People who currently have pre-settled status must make a new application for settled status before their pre-settled expires.

There were 45,700 of these Jul-Sept, with 16,200 still waiting for a decision.

A rough calculation shows that around 45,000 of these 'upgrades' need to be made every single month until the end of 2025 if all pre-settled holders are to secure their rights.

This is why we do not believe that the backlog can be cleared by spring 2022.

3⃣ Joining family members

The Withdrawal Agreement provides that certain family members of EU citzs (in the UK before Dec 2020) can make an application to join them in the UK.

There were 35,800 JFM applications submitted between July and September.

A staggering 35,400 of these are still waiting.

Only 400 concluded.

Family Permit applications are not even included in these statistics.

Not only are 99% of post-July JFM applicants still waiting, but of the few who had a decision only two-thirds got status.

We are aware of at least one case where the person was wrongly refused, DESPITE a recent (very overdue) fix to the immigration rules.

These numbers represent thousands of split families.

Many tell us the lack of transparency and progress info adds huge extra anxiety.

This affects both family of EU citzs in the UK, and @BritishInEurope trying to return to the UK with their family.

As for children's applications, we don't understand why these are so over-represented in the backlog.

Ever since the scheme began, under-18s formed 15%-ish of all applications.

But their share of the backlog has been higher from the start - now a whopping 34%.

On July 1, EU citizens who haven’t applied for status will lose their rights. No one should become unlawful on 1 July. This goes against the promise made in 2016. Innocent people will have the rug pulled from under their feet. Image
We have warned the Government since 2016 about the risk of making people unlawful overnight. It’s now happening in a week’s time on a big scale. As an example, 1 in 6 EU citizens receiving pensions and benefits have not applied yet.

While applying for status has been straightforward for many, there are barriers for vulnerable people and children, as highlighted by the @MigObs. The Home Office knows that innocent people will become unlawful residents on 1 July.
