THREAD: Fair Play For Women is back in court defending the meaning of sex. This time its the Scottish Government wanting to change sex into gender identity in the Scottish Census /1
The Scottish guidance is unlawful. It says people may self-identify when answering the sex question in the census.
“If you are transgender the answer you give can be different from what is on your birth certificate. You do not need a Gender Recognition Certificate. /2
The Scottish Government is ignoring the UK-wide 1920 Census Act and our win in the English High Court that sex CANNOT be self-identified /3
Shockingly, they have tried to defend their decision by saying “This guidance is the same as that discussed with the Parliament when the census legislation was agreed".
Truth is they TRIED AND FAILED to amend the 2020 Census Order in Scotland. /4
The Scottish Government does not have the power to force through unlawful guidance and circumvent the will of the Scottish parliament. We are taking this legal action to stand up for the rights of our Scottish supporters. /5
Extreme gender ideology is deeply embedded within the Scottish Government. Winning this action will constrain the Scottish Ministers’ pursuit of their ideologically-driven agenda with no regard for Scottish women or long-standing UK laws /6
There is a separate question specifically for transgender people to register their identity in the Census. There is absolutely no need to answer the question about sex with a gender identity too.
Accurate data on sex is important, particularly for women and girls in Scotland /7
Good data on sex matters. Small errors in sex data can have large distortive effects. Here's how /8
We did everything we could to prevent this going to court. We engaged with National Records of Scotland @NatRecordsScot, the statistics regulator @StatsRegulation and the @EHRC. In the end is was up to us to be the ones to act and say no. /9
The ONS wasted over one hundred thousand pounds to fight and lose in court. Its beyond belief that the Scottish Government are now putting Scottish tax payers money at risk. This is a reckless political act and a failure of all the public institutions involved /10
It should not be up to ordinary members of the public to hold the line on what is and isn't lawful. But once again it is up to grassroots women to defend the existing rights of women and girls.
This is another David and Goliath fight but one we are determined to win /11

THREAD: Yesterday BBC2 are rather bland and uninspiring 90 minute documentary called "womanhood". But within it they spared 15 mins to cover "the trans debate". 😱 /1
First they went to a night club to meet a transgender woman called Evie. Evie passes so well that even the fiancée of 4 years didn't know his girlfriend had been born male. Cue lots of cooing and smiles from the celebs and Shirley Ballas asking the obvious question /2
Tense music.... the celebs are preparing for their next interview. Suzi tells us how she fears they might be "platforming some quite hateful views". She tells us how toxic it is and how it becomes a "slagging match". Suzi resolutely declares "I don't want any part of that!". /3
Baroness Jenkins asks @GEO minister whether she agrees that a small misclassification of sex can have a large distorting effect on gender pay gap in professions where <5% workforce is female /1
She gets a very unsatisfactory answer from the minister:
"no plans to change the guidance...gender pay is not supposed to be a data collecting exercise...to do so would increase the burden on employers" /2
Employers are obliged by law to COLLECT DATA on the gender pay gap and GEO publishes it.
And the point of it is to determine gap in pay between males and female
Of course its a data collection exercise! And of course sex matters! /3

As part of that work we discovered that the NHS were developing Unified Information Standards for each of the protected characteristics. The NHS refused to reveal to us what their recommendations to ministers would be /2

@DavidTriesman Baroness Noakes @1SVN hits the nail on the head. The only way to have safe and fair sport for ALL is to have two categories. An open category for everyone and one reserved for natal women only /2
@DavidTriesman@1SVN The minister replies "the evidence is clear that there are retained advantages in strength, stamina and physique for the average transgender woman, with or without testosterone suppression. It's not proved to be the silver bullet many hoped it would be". /3
Something big happened around 2015. There was a surge of transgender policies. Few noticed and other stakeholders were not consulted. This sloppy practice led to the mess we are in today /1
It was around this time that trans-activists captured the gay rights organisation Stonewall. /2
In 2016 we also saw prison policy change to allow male prisoners to self identify as trans and move to women’s prisons. /3
