So by partaking in an illegal occupation protest, does police understand that all those commercial vehicles are violating the terms of their liability insurance? Insurance carriers can deny claims/essentially jump off risk. Let’s say, one hits a pedestrian/building/blows up
Every large truck/commercial pickup parked in the middle of the streets will have no coverage if an incident occurs. This would mean the city will be 100% liable. Yes of course there will be subrogation. It is a potential legal mess that taxpayers will underwrite
Each and every commercial vehicle (I’d argue also private vehicles partaking) is a claim waiting to happen. None would have liability insurance at this moment. Care/custody/control. They’re using their vehicles for a non-commercial use.
That their using their commercial vehicles as weapons/private interest, means that the truck owners also face liability which could extend to their home/business insurance. Which also can be denied w/coverage cancelled due to illegal use
If lawsuits start coming in, which I believe they will, it will be the biggest wallet targeted first. That will be the City of Ottawa & Ottawa police services. Then Mayor/Chief, protest organizers on downward. It’s a quagmire of liability
If one of those ladies who confronted the trucks yesterday, got hurt in anyway, they can lay claim.
Just seeing police allow truckers to move fuel on carts..I kept thinking “holy shit, if something happens”
People never understand until they are chin deep
It’s why I cannot understand why police aren’t giving tickets. It’s their one way to advert some liability. Yeah, they’ll all be sued if something bad happened. But they can at least say the truck owners were given notice in writing.
Let me clarify. Victims of any accident will receive payment by insurance. However, subrogation to everyone else responsible & extended lawsuits will be a legal nightmare that will cost the city & taxpayers
It’s why protests:events usually require a permit w/$2mil+ insurance liability. It gives the city a firm control on the organizers. As well as spreading the risk. Not demanding a permit/allowing this to go on? Far beyond a reasonable time ….
Add in negligence to any claim.
And Commercial truck insurance is one of the hardest to get. It’s expensive. And it gets denied often
FYI. I started my working career as an underwriter for boiler insurance. Yeah they gave me the sexy portfolio. But it’s the most precarious liability mess if someone doesn’t do their due diligence
Then I was the national adjuster for a large Canadian firm who did car repairs. Let me tell you. You’d be amazed how many times cars fall off garage lifts. 🙄
Stayed up a bit reading up on Commercial trucking standards/Ins…because I’m a nerd. I wanted to make sure I was correct before I mentioned trucking logs required by law, would need to be made available to ins carrier if claim made
Each commercial vehicle registered is mandated to keep logs. These have to be handed to law enforcement. Also given to commercial insurance carrier to process any insurance claims. It’s to ensure the vehicle is being used for commercial purposes
So yeah, right at this moment, any of the trucks sitting/driving in these protests have no commercial liability coverage. The MTO also includes pickup trucks registered for commercial use. All are in violation of MTO (provincial) laws & against commercial ins coverage
MTO can seize these trucks, it’s in their power, as they’re being used illegally outside of required commercial use, & violating liability terms with carriers.
It’s not a sexy law enforcement take down using police tactical squads. It’s like being arrested by your accountant
You can have your “Freedom”, but your insurer can also have their “Freedom” by no longer covering your trucks if it’s being used outside of commercial use.

I’m going to add, it may be even harsher for the Quebec truck owners. As their system is public, with required third party liability coverage obtained privately. They will still lose license/coverage for use in other provinces. And jump hoops thru a Quebec govt regulator
And right on cue. Police are using plate readers, I’m betting MTO will be setting up inspection sites on perimeters. Those with commercial vehicles do not fully understand the financial precipice they are standing over
Oh goody! I get to stay up & read up on farm equipment insurance!!! Off the top of my head, insurance carrier has to be notified if equipment is moved for commercial use elsewhere. Sometimes a special addendum has to be added to that vehicle, logs kept if it’s used elsewhere
This one is a real doozy. Not only would non-commercial use of equipment be against policy, also it brings criminal charges for road use. most equipment is tied to a business..ie: farm/contractor etc. It would be under a fleet policy. FUN FUN FUN
Like moving it away from the business it’s tied to, without it being insured off-property (excluding maintenance repair) brings a whole bunch of issues. Plus some of these Farm bad boys can be the price of a new Lamborghini

The young guy said he’d just gotten his life together,got this job, stopped doing heavy drugs, that he made so many friends in the Anti-vax online groups. He feels he’s in a community now

First, organizers can be sued for costs, police, business interruption, damage. The person who died as a result of protest vehicles blocking the ambulance, their family can/should sue for wrongful death. Organizers can be charged for involuntary manslaughter.
Everyone of those driving vehicles in this protest can be charged under highway safety. Police should be checking for insurance & outstanding warrants. Start impounding vehicles. Trucks used in this should be suspended by MTO, they will lose insurance coverage.

So the protest at Vaughan Mills has shut down the malls parking lot. People are running thru gridlocked traffic as police sit drinking coffee.
You can’t get over the bridge on Langstaff over the 400. Pickup trucks have blocked access. People are screaming at cars that are stuck. No police anywhere.
You cannot drive anywhere near Vaughan Mills. Flag waving pickup trucks are driving up on sidewalks to bypass gridlock. It’s bedlam.
