Happening now: Plea hearing for Thomas Baranyi, of NJ. Baranyi told my colleague @arianedatil he was right next to Ashli Babbitt when she was shot. "It could have been me, but she went in first," he said. He'll be pleading guilty to entering/remaining in a restricted building.
"We tore through the scaffolding, through flash bangs and tear gas, and blitzed our way in through all the chamber just trying to get into Congress or whoever we could get in to and tell them that we need some kind of investigation into this," Baranyi said.
Here's Baranyi describing the moments before Ashli Babbitt was shot: "We had stormed into the chambers inside and there was a young lady who rushed through the windows. A number of police and Secret Service were saying get down, get out of the way. She didn't heed the call..."

The sentencing for William Blauser is happening now before Judge McFadden. DOJ says probation is warranted given the factors below as well as his efforts to restrain his co-defendant, Pauline Bauer, inside the Capitol.
Blauser's attorney says he "regrets ever coming that day and getting swept up in the crowd." Says he came to D.C. with his best friend of many years, Pauline Bauer. Bauer is also charged in the case and has not pleaded guilty.
Blauser: "Your honor, I am remorseful for what I did on January 6, 2021... I'll never get into those kind of situations again. For now, my plans are to take care of my family, take care of my friends, take care of my fellow veterans to the best of my ability."

Judge Mehta says he's disinclined to mail out a jury questionnaire. Says that introduces a lot of potential issues. He'd rather do the questionnaire at the courthouse.

The plea hearing for Aaron Mostofsky starts at noon before Judge Boasberg. Here's the call-in info:

Aaron Mostofsky will be pleading guilty to three counts:

- Civil disorder (felony)
- Theft of govt. property (misdemeanor)
- Entering a restricted building (misdemeanor)

Plea deal means he'll avoid the big obstruction charge that carries a maximum sentence of 20 years.
The maximum sentence Mostofsky can face on the civil disorder charge is up to 5 years in prison and a fine of up to $250,000. The other two charges are Class "A" misdemeanors with max sentences of up to 1 year in prison.

Starting now: Status conference for Proud Boys Dominic Pezzola and William Pepe. Judge Kelly says he's going to deny their 1512 obstruction challenge as he and other judges have in other #CapitolRiot cases. wusa9.com/article/news/n…
One of Pezzola's attorneys, Steven Metcalf, offers to provide more arguments on the obstruction issue. Judge Kelly basically says, he's heard it. He and other judges have ruled on the issue and they've all agreed its applicable.
Metcalf doesn't want to let it go. He wants Judge Kelly to dismiss it without prejudice. Kelly says it's a "purely legal issue" and he doesn't see what could happen in the future to change his view on the ruling.

Status hearing happening now for Richard Bigo Barnett, the Arkansas man who entered Speaker Pelosi's office on January 6. His attorney, Joseph McBride, wants to delay a trial date, but Judge Cooper wants to get it on the books. Says it's been pending too long. #CapitolRiot
McBride has several January 6 defendants, including a few accused of serious felonies. His calendar is therefore, pretty booked. DOJ says they're all having to schedule trials uncomfortably close.
DOJ says no plea offer has been extended because of "lack of interest in the type of plea offer the government would extend" (i.e. a felony plea). McBride calls that "speculative." Cooper says, basically, figure it out among yourselves.
