#WAOpioidTrial Regardless, we resume with the state of WA and their witness Dr. Caleb Alexander . .. notoriously PROP-affiliated, anti-opioid, 'everyone using opioids for pain is at risk of addiction' doctor who is here with a plan to 'abate' the epidemic in WA. Sigh.
#WAOpioidTrial To be clear: people in the know in WA are reasonable and appropriate. The Washington Medical Commission. The WA Dept. of Health. Assorted agencies. They recognize that people in pain deserve individualized care and that providers should be protected/encouraged.
#WAOpioidTrial I seriously fear that my state AG's office does not know or does not care how many state residents have been harmed by the vitriol & bias of this witness; & by their office's actions. There are hundreds of thousands of us in WA who DO know and do care. And we vote.
#WAOpioidTrial State has Dr. Alexander describe the first page (only) of a big, detailed spreadsheet and then tries to admit the entire workbook. Defense (rightfully) objects to tons of pages not discussed or reviewed going on the record. Judge sustains. State's trying again...
#WAOpioidTrial Dr. Alexander is vehemently stating how critical it is that people with OUD get *individualized* care according to their needs.

Yep. That would be great. Everyone should always be getting that.

Including people with pain. All kinds. Including chronic pain. 🤯
#WAOpioidTrial Dr. Alexander is just detailing all of the different categories/costs of his 'abatement plan' for WA state that HE developed. At the behest of the state AG.

I wonder how the addiction specialists of WA state feel about this plan? Has anyone local vetted this?

#WAOpioidTrial We resume cross-examination of the pedantic Dr. Caleb Alexander by McKesson's counsel.

And immediately the state raises an objection, which is overruled. And then the state tries to keep arguing it.

And the judge re-overrules.

Um. It sure seems like understanding THOSE things would be super-helpful at figuring out how to address things.

#WAOpioidTrial To recap the end of the day: Dr. A agreed he wasn't blaming defendants, or criticizing their handling of suspicious orders, or requiring any changes to their business practices. Nor did he differentiate AT ALL between illicit and RX opioids for ANYTHING. Sigh.
The more interesting bit at the end of McK's cross: Dr. Alexander has provided these reports in 7 opioid cases. His company - Monument Analytics - has been paid $6 million for trial reports as of last summer. Dr. A bills for this trial work personally at a rate of $900 per hour.
Dr. A used to own 100% of Monument but now owns only 65-75% he estimates. (He also makes around $225K per year in salary at Johns Hopkins). He'll have pocketed between $3.9 million to $4.5 million in OPIOID LAWSUIT money (65-75% of $6m).

Well. I wonder what his motivations are?
#WAOpioidTrial THAT IS CORRECT. Yet another expert witness is pocketing MILLIONS of taxpayer dollars on these opioid lawsuits. Literal millions.

To tell judges that RX opioids caused the overdose crisis. And that manufacturers, distributors, pharmacies and doctors did too.🤦🏽‍♀️
#WAOpioidTrial Other things we learned today: Despite using NSDUH data in all of his models, when Dr. Alexander was shown NSDUH data showing a decline in opioid death rates in WA he reacted angrily saying "You can't trust NSDUH data, it is notoriously inaccurate/inconsistent'. 👀
#WAOpioidTrial Mck: You're aware that illicit fentanyl is causing far more harms than heroin today, correct?

Dr. A: They are both huge problems. I mean they are massive problems.

McK: But Illicit fentanyl is more than heroin, though?
Dr. A: Heroin often has fentanyl in it.
#WAOpioidTrial McK: Okay but LITERALLY here in WA illicit fentanyl is a bigger problem than heroin and the heroin in WA doesn't usually have fentanyl in it, according to the data?

Dr. A: Well, yes.

SIGH. Was that so hard?!!

Oregon. I'd composed a whole thing about how a Senator from Bend just introduced a new bill to shift $120million away from the state's Drug Treatment and Recovery fund and TO 'general law enforcement needs and to tackle illegal marijuana farms'. Yeah.

Only it seems Sen. Tim Knopp (R, Bend) just dropped SB 1541 (which would have robbed tax revenues from last year's Measure 110) after .. presumably a cacophony of incredulous rage from all corners. He'll "revisit next year" instead. Cool cool cool.

We are starting with the arguments for/against striking all of former DEA's Ruth Carter's testimony (which was SO MANY hours). It's a defense motion to strike. Let's watch.

#WAOpioidTrial Defense says Carter missed a bunch of things, admitted on cross she'd never reviewed WA-state-specific things, etc. State is saying it was all finde etc. But the judge ... seems to be troubled about state's position on all this. Is he going to strike Carter?! 🤯
#WAOpioidTrial In a nutshell: 'Carter did not lay the proper foundation, did not do the proper research to CONCLUDE the things she stated categorically on the stand.' There were lots of holes. Expert witnesses are expected to seriously connect the dots. We shall see . .

#WAOpioidTrial IANAL here but it seems like the state just got admonished a bit for trying to pull some exhibit back OFF the record after defense went to the expense of reviewing; state doubles down and says they are SURE it will be in; then tried to pull it. Judge said nope.
#WAOpioidTrial And now we resume McKesson's counsel cross-examining Dr. Daniel Ciccarone, MD, MPH. He's a widely respected harms reduction expert (among many other things). He's been testifying about the uptick in heroin/fentanyl use, generally.
