They are literally having the Former Chief Economist for the U.S. Office of Management and Budget read out the number values from various cells on many, many pages of spreadsheets. 🤦🏽‍♀️

#WAOpioidTrial I wish I were kidding. They're asking the witness to read out the projected costs of various programs, by year for each year from 2021-2035. We're on the 11th row. With 15 values each (1 per year). He's read out 165 values, each one in the millions. Plus totals.
#WAOpioidTrial Why did I do that math? BECAUSE this witness has at least <checking screen> 10 more rows (or 160 more values, each in the millions) to go. This will take some time.

"Could you read the cost of <program> for every year from 2021-2035? Plus the total?" Sigh.

Witness: Yes.

Basically: State was trying to buy time to huddle & strategize before tendering the witness. Our judge saw RIGHT THROUGH IT and said nope. Also Judge is a BIG FAN of efficiency. Don't mess w/his system!

Dr. L: I'm developing a forward-looking solution; I'm not looking backwards at anything that happened in the past.

McK: And you're not offering any opinions on whether the distributors <contributed to the crisis>?

Dr. L: Correct.
#WAOpioidTrial Also his cost projections are adjusted for future inflation - so the costs are in future dollar values. He did not present any current-value calculations.
#WAOpoidTrial McK is pointing out that Dr. L included the cost of counseling/therapy along w/ALL patients receiving MOUD (meds for OUD), after there has been much discussion about how counseling/therapy is NOT required for patients receiving MOUD. Challenging his math. Debating.
#WAOpioidTrial The disconnect may lie in Tricare terminology being different than civilian ...the person administering MOUD is 'counseling' patients (per Tricare) when they give meds, but not like - intense behavioral psychotherapy. Which is what I think is assumed by civilians.
#WAOpioidTrial McK is doing lots more math breaking down the costs of various MOUD meds and administration costs and such, mainly based on DOD/Tricare estimates.

Also Dr. L developed an abatement plan for the Purdue legislation in July 2019 for WA state. 🤔
#WAOpioidTrial Aha. That's the trick with these expert witnesses who testified in earlier trials: ask them the SAME question one anticipates they'd have the same answer. But often they do not. You'd better believe counsel has their previous transcript to show them the difference!
#WAOpioidTrial The line of questioning here appears to be: the overwhelming majority of the costs of the 'abatement plan' is people w/OUD receiving therapy. So if less are getting therapy, the costs would be MUCH less.

Here's what I'm wondering, though.

In a perfect world, anyone w/OUD who wants therapy WOULD GET IT. But the thing is: we have a national shortage of therapists currently. Gods help you if you need an actual Psychiatrist!

#WAOpioidTrial Day 28 beginning. Random thought: Are bench trials far more stressful for judges than jury trials? In a jury trial judge has to make sure the jury hears appropriate/admissible evidence, then jury decides. Bench must do same AND then rule.?

Oregon. I'd composed a whole thing about how a Senator from Bend just introduced a new bill to shift $120million away from the state's Drug Treatment and Recovery fund and TO 'general law enforcement needs and to tackle illegal marijuana farms'. Yeah.

Only it seems Sen. Tim Knopp (R, Bend) just dropped SB 1541 (which would have robbed tax revenues from last year's Measure 110) after .. presumably a cacophony of incredulous rage from all corners. He'll "revisit next year" instead. Cool cool cool.

We are starting with the arguments for/against striking all of former DEA's Ruth Carter's testimony (which was SO MANY hours). It's a defense motion to strike. Let's watch.

#WAOpioidTrial Defense says Carter missed a bunch of things, admitted on cross she'd never reviewed WA-state-specific things, etc. State is saying it was all finde etc. But the judge ... seems to be troubled about state's position on all this. Is he going to strike Carter?! 🤯
#WAOpioidTrial In a nutshell: 'Carter did not lay the proper foundation, did not do the proper research to CONCLUDE the things she stated categorically on the stand.' There were lots of holes. Expert witnesses are expected to seriously connect the dots. We shall see . .

#WAOpioidTrial IANAL here but it seems like the state just got admonished a bit for trying to pull some exhibit back OFF the record after defense went to the expense of reviewing; state doubles down and says they are SURE it will be in; then tried to pull it. Judge said nope.
#WAOpioidTrial And now we resume McKesson's counsel cross-examining Dr. Daniel Ciccarone, MD, MPH. He's a widely respected harms reduction expert (among many other things). He's been testifying about the uptick in heroin/fentanyl use, generally.
