I can’t believe this evidence was given to the Select Committee in June 2021 but has not been reported by the MSM. It is a long & difficult read but leaves me in no doubt at all that this government & its agencies have been negligent in their legal duty to protect HCW’s. 1/
I have been writing to my MP @tomhunt1988 since April 2020 stating my concerns about his governments handling of the pandemic, the inadequate protection against Covid for HCW’s & providing considerable supporting evidence. To date I have not received any explanation. 2/
David Osborn BSc, CMIOSH, SpDipEM Chartered Safety and Health Practitioner should be applauded for speaking out & all healthcare unions & professional organisations should be calling for further investigation into his very serious allegations. He states:

“I have involved myself simply through a sense of moral and ethical duty, recognising that so many of these good people (for whom we so enthusiastically clapped last year),

have been badly let down by the provision of woefully inadequate respiratory protection that has endangered their lives.”

I urge everyone to read the attached damning statement & write to their MP demanding action. Our HCW’s & their grieving families deserve justice.

Some interesting points raised:

“There is evidence that, just prior to the 13th March, the Deputy Chief Medical Officer (DCMO) had already issued draft guidance to the NHS that fluid resistant surgical masks (FRSMs) would be used instead of FFP3 masks.

The problem was that since COVID19 was classified as a High Consequence Infectious Disease, the rules specified that respiratory protection to the standard of FFP3 respirator masks had to be used to protect HCWs & it was evident that there were insufficient to supply these.

There then followed some hurried discussions between the DCMO, NERVTAG and ACDP committees with the result that, within 2 hours and without any scrutiny of evidence-based research papers, COVID-19 was conveniently declassified as an HCID.
9/
The minutes of the NERVTAG meeting recorded that SAGE had also approved the declassification, yet SAGE minutes reveal no evidence of the matter having ever been discussed by them.

Within a few days the new guidance mandating surgical masks instead of FFP3 was issued across the UK and within a few weeks the infection and fatality rates amongst HCWs began inexorably to rise.”

Osborn’s allegations are so serious that he has urged a formal police investigation alongside an HSE inquiry.

“I suggest that if this matter is considered in a Court or Inquiry, it is likely to be deemed that:

- the authors and publishers of the IPC guidance owed a ‘duty of care’ to healthcare workers and others who may be affected by their guidance;

- the ‘duty of care’ was breached by the delivery of guidance which has endangered health and arguably cost lives.
13/
- The health of workers has been harmed and lives have been lost as a result of that breach.

You will of course recognise that the above 3 elements are the criteria which constitute ‘negligence’.

Normally, when work-related deaths occur and there is a suspicion of negligence then, under the ‘protocol for liaison’, the police will investigate alongside the HSE to determine whether offences have been committed by individuals (gross negligence manslaughter)

&/or by organisations (corporate manslaughter). There is sufficient evidence to warrant such a referral to the police.”

This is really serious stuff & I hope you’re all as angry about this as I am. I want further action & compensation for all those who were so badly failed. End/
