Good morning all. The second day of testimony will begin shortly for Texas Three Percenter and #CapitolRiot defendant Guy Reffitt. Here's what happened in day one. wusa9.com/article/news/n…

Judge Friedrich tells the lawyers several jurors have said they can't see Guy Reffitt from their seats. Reffitt's attorney does blocks the view from the left side of the gallery. Friedrich says she doesn't see that as an issue, since what he does in court isn't evidence.

DOJ says they believe jurors are entitled to see the witness and can consider his response to witnesses/testimony during deliberations. Friedrich says she's going to review the case law before saying anything to the jury about it.

AUSA Jeffrey Nestler says the government expects to rest its case early Monday. Were hoping to rest tomorrow, but audio issues yesterday slowed things down.

Government's case will resume today with more testimony from USCP Inspector Monique Moore. She started walking jurors yesterday through various surveillance videos of the #CapitolRiot.

Jurors now seeing video of Vice President Mike Pence's motorcade being relocated from the east side of the Capitol.

USCP Inspector Monique Moore says she saw that as the Secret Service viewing the crowd as becoming a "threat."

AUSA Restler ends his questioning of the witness. Reffitt's attorney, William Welch, is cross examining now.

Asks her about the ~1,600 cameras on Capitol grounds. Moore says they can be operated by a human. Zoomed in and out, etc. The footage is all recorded.

Inspector Moore says officers can't edit or delete footage. Welch asks if the videos the jurors saw are accurate representations of what happened on January 6. She says yes. Passes the witness. No redirect.

The next witness will be FBI Special Agent Stacy Shahrani, from the FBI Computer Analysis Response Team. She'll be asked about evidence recovered from Guy Reffitt's electronic devices, including SMS messages and Telegram chats with other Three Percenters.

Shahrani says she examined a camera, cellphone, tablet and external hard drive all belonging to Guy Reffitt. The camera was a GoPro attached to the top of his helmet during the riot.

Agent Shahrani now going over texts between Guy Reffitt and his family:

"What's about to happen will shock the world."

"The entire house of legislation has committed unthinkable acts on our people. We have had enough. Time for a new party."

Another text from Guy Reffitt:

"Exactly, time to remove them. That's why I'm going to D.C. Promise, I'm not alone."

Shahrani introduces a text from "Pitter Pats," who I guess to be Reffitt's younger daughter Peyton:

"dad please be safe !! You know you are risking not only ur business but ur life. And that isn't just something to through away lol"

Another text from Guy Reffitt, sent on 1/8/2021:

"Shot multiple times with clay balls and Pepper Sprayed heavily. We took the United States Capitol..."

Guy Reffitt sent his family a link to a video played on Fox News' The Ingraham Angle. He gave them the time stamp where they could see him in his blue jacket on the steps of the Capitol.

Now Telegram chats extracted from Guy Reffitt's phone. Reffitt's Telegram account name was "Call to Arms."

Reffitt urged others on Telegram to go to DC on the 6th to support Trump and for "cutting the head of the demon."

"Sleep and wake on the 6th for Armageddon all day."

Reffitt sent a Telegram message saying he was going to drive to D.C. because he couldn't get his "battle rattle" there via plane.

Another Telegram user told Reffitt he wouldn't be able to accomplish anything in D.C. unless "you drag the traitors out."

Reffitt responded: "I don't think anyone going to DC has any other agenda."

In another message, Reffitt said he had "arranged my affairs here at home." He said if he died on 1/6, his security business would go to his wife.

He said his business would provide guns and training to people and that it would shield people if "they" come for the Average Joe.

More messages from Reffitt on/after 1/6:

“We took the Capital of the Untied States of America. What have you done today?”

“I had to fall back due to pepper spray to the face. I was the lead up the Capital stairs.”

“Multiple clay bullets and a battle cry like Braveheart…"

A message from Guy Reffitt to the Texas Three Percenters Telegram chat after the militia's state lead was questioned by law enforcement:

“THIS IS NOT A DRILL. THIS IS NOT A DRILL. He has just called me to spread the word. The shit has hit the fan.”

After a break, testimony resumes. DOJ enters a Telegram message AUSA Nestler mentioned during his opening statement:

“I got hit with rubber bullets and pepper sprayed. I was the first person to light the fire on the Capitol steps. WE TOOK THE CAPITAL…!!!”
