Hearing now in Whitmer case on defense pre-trial motion to obtain more information about payments, etc to numerous FBI informants.

Defense asking for all documents including agreements btw FBI and informants. "We should have those materials," Adam Fox's attorney says.
Records relating to CHS Jenny, CHS Dan, CHS Steve.

Asking for admonishments to those CHSs. Payment ledgers--amounts and dates they were paid for either services or reimbursements.

"Government allowed people in this case to do things that were not necessarily lawful."
Atty also wants info on FBI vetting process on CHSs.

"We would like whatever documentation the FBI uses in the vetting and validation process. We know for a fact...that FBI has nondisclosure agreement with CHS Steve." Robeson is a convicted felon who committed at least...
2 other crimes while he worked as one of the lead informants in the caper. DOJ won't call him as a govt witness--DOJ also removed top 3 FBI agents from the case.

Defense notes that CHS Steve was head of Wisc 3 percenter then made Adam Fox head of Michigan 3 percenters.
Defense says CHS Steve undermines credibility of government's case.

"If we call these witnesses as hostile witnesses and we can't impeach them...it's categorically unfair. Impeaching him is part of the process."

Says Fox would not be head of 3 percenters without FBI involvement
Another defense atty argues how much CHS Steve, who organized every meeting and recruited defendants to attend, was paid shows motivation for what CHS Steve did.

CHS Steve paid at least $20k -- not clear if it's reimbursements or compensation. Asking about nondisclosure...
"government put a gag order on a fact witness."

Atty again argues FBI created Three Percenters in WI and MI (WOW) and CHS Steve organized key meeting in Ohio in June 2020 to set up the defendants.

Some of my coverage here:
amgreatness.com/2022/02/10/hig…
DOJ: Will provide Brady/Giglio on CHS Dan today. It's 3 pages. (Dan was paid around $50k)

DOJ won't call CHS Jenny and won't provide any info.

Judge asks DOJ if defense asks Jenny to testify, will DOJ will provide info. He says yes, will be similar to Dan's.

Now to CHS Steve..
DOJ says his file is larger because Steve was a "problematic" source. DOJ has not furnished account of how much Steve was paid by FBI.

DOJ says payments to CHS Steve were both for services and reibursements.

DOJ says idea FBI created Three Percenters is a "red herring."
Judge orders private viewing of nondisclosure since defense hasn't seen it.

Judge challenging defense to explain why they want this info now and not when trial proceeds if necessary. Defense argues its Brady material.

Hearing adjourned, judge will issue decision soon.

This is a post from last week by the wife of Joshua James, the man who pleaded guilty to seditious conspiracy.

Ok up next: Plea hearing for Joshua James, the Oath Keeper in the Stewart Rhodes' seditious conspiracy case.

Judge Mehta presiding:

justice.gov/usao-dc/case-m…
James is not detained, sounds like he is appearing remotely not in person. (Not the clearest connection.)

James, 34, pleads guilty to seditious conspiracy and obstruction of an official proceeding.

WOW
Mehta seems surprised, detected hesitation in James' voice, asks him again if he understands the plea agreement.

James was helping with "security" that day (Stone, I think) and was in the building for about 5 minutes.

He will cooperate with the government, per plea.

Before Oath Keepers' plea hearing, listening to Judge Amit Mehta considering pretrial detention for a new J6 defendant. Mehta wondering aloud why so many "law abiding citizens" acted up that day.

"Why, because you thought the election was stolen contrary to all the evidence?"
Someone needs to send Judge Mehta a copy of Mollie Hemingway's book or maybe even this.

BTW this is a new one for me. DOJ attempting to shield the name of police officers involved in brawls, attacks by insisting they are entitled to privacy under Victims Right Act. So this is how police are described:

Status hearing now with Timothy Hale before Judge Trevor McFadden.

Hale has been imprisoned since January 2021; McFadden, a Trump appointee, has held Hale behind bars under pre-trial detention orders.

His trial is set for May 23, 2022.

DOJ says "hundreds of thousands of FBI...
files still have not been unloaded to the sharable database. They won't be available until April as they undergo "review."

DOJ addressing chronic issue of defendants in DC Gulag (where Hale is) not being able to see discovery. She blames it on Hale not signing protective order.
DOJ will file a superseding indictment in a "matter of weeks" to remove its lie that Kamala Harris was in the Capitol on January 6.

DOJ wants another exclusion from Speedy Trial clock; defense objects.

Hale's original trial date was November 2021.

Hale says he won't sign...

This is your average reply. After calling Trump an authoritarian for years without evidence, Democrats get mad when the label is accurately applied to Biden and in their rage endorse his authoritarianism against Trump supporters
Fabricating evidence. And this is just one example

Making up charges. Again this is one example — obstruction of an official proceeding is another

Let's do a little flashback to late 2019, early 2020 when Democrats, supported by NeverTrumpers now banging the war drums, covered up Biden-Ukraine grift and Ukraine's interference in the 2016 election with impeachment ruse.

Remember Alexandra Chalupa?

Remember when George Kent confirmed Ukraine's endemic corruption and admitted Hunter's "board appointment" to Burisma was a major problem?

Forgot about this from my Feb 2020 column: "Under Biden’s direction, leaders in the European Union brokered a massive bailout for Ukraine. The veep helped negotiate a $17.5 billion aid package from the International Monetary Fund."
