Australia has signed the Refugee Convention, which says that people who come seeking safety without first seeking permission (a ‘visa’) cannot be punished. There is no offence under Australian law for arriving without a visa.
Mr Morrison was asked about our Biloela family on @BreakfastNews this morning.

Under Australian law, Immigration Ministers have the power to intervene in any immigration case and grant a visa to stay in Australia if they think it is in the public interest.
The Ministers’ power to grant a visa to stay in Australia is completely independent from the decision of any court.
There is no requirement for Priya, Nades, Kopika or Tharnicaa to be formally recognised as refugees for the Ministers to grant a visa to stay in Australia.
In May 2019, the former Immigration Minister David Coleman asked his Department to prepare a brief on the family.
He did this because the family's legal team asked him to allow a protection visa application to be made for youngest daughter, Tharnicaa.
"Successive immigration ministers have been able to use their intervention powers to grant the Biloela family visas ever since the very first refusal decision was made many years ago."

“Today, the Prime Minister was asked by journalists when Immigration Minister Alex Hawke would make a decision on whether the Nasdesalingam family could go home to Biloela.

Today @AlexHawkeMP used Migration Act powers to grant 12-month bridging visas to 3 members of the Biloela family. However Tharni has not been provided a visa. The family remains in “community detention". 1/
By continuing to withhold a bridging visa from Tharni, Mr Hawke is preventing the family from coming home to the QLD town of Biloela.
Last week, the Minister made an undertaking to the Federal Circuit Court to issue 3 month bridging visas to Priya and Nades and Kopika.

We are “surprised” by the Minister’s decision to now grant 12-month visas to three of the four family members, while continuing to withhold a bridging visa for Tharni, which would allow the family to return to Biloela. 3/
STATEMENT: Biloela family Federal Court decision.
Today, the full Federal Court handed down its decision involving the Tamil family from Biloela.
In an emailed decision sent to all parties on Tuesday morning, the Federal Court has upheld Justice Moshinsky’s April 2020 decision.
Lawyers for the family will now determine whether to appeal and call upon the Australian Government to immediately release this family from detention while legal matters are ongoing.
Lawyers for the family are currently assessing whether an injunction or stay of orders will be required to protect the family from further deportation efforts.
